While Rob and the rest of the Kardashians are saying that Blac Chyna is a neglectful mother, they may not be able to prove it in court.
According to legal experts, Chyna's excursion to Hawaii and even her violent brawl won't give Rob a win for custody.
But ... he may have a path to getting full-time custody of little Dream.
After Rob found that Chyna's nannies were there for Dream but not Chyna herself, he accused her of being an unfit mother.
He is even trying to make a case for full custody in court.
HollywoodLife asked California Family Law Attorney David T. Pisarra if Chyna's Hawaiian trip without Dream supports Rob's claim.
"Not really," Pisarra assesses. "Maybe if it was a pattern, but if it’s a one-off it’s really her word against his."
"She can say she did tell Rob," Pisarra suggests. "I’m not going to say it’s a humongous issue."
At least, not the sort of smoking gun one wants for a custody victory.
Pisarra does note that Chyna's travel could impact her custody ... if she made different choices.
"The bigger issue is if she took the kid to Mexico, or to France, and didn’t tell him," the attorney suggests.
"Then," he understates. "That would be an issue."
One parent taking a child to another country while the other parent, who has shared custody, knows nothing of it?
That can be viewed as kidnapping. That's just not what happened here.
"The child was fine," Pisarra notes. "So I don’t think the judge is going to get upset with that."
So Chyna leaving Dream with nannies gets a pass.
But what about Chyna's scary brawl with Kid Buu that she had while she was in Hawaii?
"Chyna’s domestic violence with Kid Buu is also not a really big issue in Rob’s case," Pisarra says.
"Because," he explains. "Dream wasn’t there."
"If Dream [had been] present," Pisarra continues. "Now we’ve got an issue."
But if Rob wants to one day wrest custody of Dream and attain full custody, he may have hope.
"However," Pisarra points out. "We can kind of start to see a pattern here."
"And maybe," he explains. "Ss these incidents build up over the next six months or a year."
"As Rob documents all of this," Pisarra continues. "He can bring this to a judge and ask to revisit the custody arrangement."
So if Chyna is constantly leaving Dream alone to go twerk and/or fight with rappers, that could be Rob's key to victory.
"But until then it can just look like Chyna’s crazy, but not a bad mom, per se," he concludes.
According to HollywoodLife's inside source, Rob's desire for custody is serious.
"Rob is furious at Chyna for her poor behavior," the insider reveals. "And he wants full custody of Dream."
"Rob feels that Chyna is not as good of a mother as he is a father," the source continues.
"And so," the insider says. "He wants to take care of his child full time."
At least, when Dream isn't with Kris or one of his sisters.
"He is tired of hearing about Chyna and all of her boyfriend drama," the source says.
"And," the insider notes. "He does not think it’s healthy for Dream to be around all the nonsense."
Neither Rob nor Chyna are allowed to introduce Dream to significant others, but even secondhand chaos can be a big deal.
"Rob fears for who is around Dream," the source claims.
"And," the insider insists, Rob worries about "what negative influences that are in and out of Chyna’s house and life."
And then, of course, we get to the crux of the issue.
"He is also tired of paying the high child support for nannies," the source says.
Yeah. Chyna won the lottery when she got pregnant with Dream, and we don't just mean because Dream is so cute.
The insider explains that Rob is frustrated "when he feels that Chyna isn’t even always around raising Dream."
