Joe Giudice’s looming deportation has The Real Housewives of New Jersey fans on edge, but it’s immeasurably worse on his family.
Back in April, Teresa begged the court to grant a stay of deportation while Joe continues to file appeals.
Now, seemingly against all odds, Teresa has won a brief victory. But how much time has she bought for Joe?
According to documents obtained by The Blast, the court has ordered that Joe Giudice may remain in the US … for now.
The order only extends to the duration of his legal battle.
The decision was reached by the United States Court of Appeals for The Third Circuit.
As those who have been following the story may recall, Joe was scheduled for deportation … more or less "now."
This will give him more time close to his family.
It will also help him avoid the situation of appealing his immigration status from Italy.
"The petitioner’s motion for a stay of removal is granted," the court document reads.
"The requirements for granting a stay have been satisfied," the filing notes.
The document continues: "The temporary stay of removal previously granted is vacated as it is no longer necessary."
Interestingly, the document also refers to an amicus brief by "27 former immigration judges, etc."
An amicus brief refers to a friend of the court, who might write up a legal opinion to present despite being a third party.
Notably, the same report says that Joe Giudice’s attorneys plan to file additional appeals.
Keeping him here in the country isn’t their only priority during his legal battle, which could be fairly lengthy.
The legal team is also asking the court to ask Joe to be released from custody during this time.
He has served out his prison sentence, of course.
They argue that he is entitled to be at home with his family while he fights to remain in the only country that he has ever known.
Joe is reportedly hopeful that the court will see things his way in the end.
That would mean that they will permanently stop his deportation.
Releasing someone detained by immigration officials can be difficult, and may be a hard sell.
Joe’s fame and ties to the community may be enough to convince the court that he isn’t going to go into hiding.
After all, the whole point of staying here is that his entire family is here.
Many asylum seekers fear deportation because they’ll be murdered in their home country. Joe just wants to be close to his daughters.
Though we of course wish Joe the best, some wonder how much luck he’ll have.
After all, though he is white and affluent, the current administration is on a warpath against asylum seekers and undocumented immigrants.
But maybe Joe will find some sort of repireve. That would be wonderful.
That said, some fans of The Real Housewives of New Jersey think that it might be bittersweet.
They’ve seen the writing on the wall for some time now, and think that Teresa has totally moved on — emotionally, anyway.
But this isn’t about keeping a marriage together. This is about his kids. They deserve to grow up with their family.
