While other networks back down from the FCC’s taunts, NBC is growing a pair and challenging the broadcast overseer on its findings that a certain number of utterances during the Golden Globes or Billboard Awards were somehow obscene.. (How very Studio 60, we know.)
In its brief to the Second Circuit Court of Appeals in New York in the broadcaster court challenge to that new FCC profanity enforcement policy, NBC says the FCC decision should be reversed and that “no reasonable observer could actually conclude that Cher was exhorting the audience to have ’sexual activities’ with those critics, or that her comment related somehow to sexual organs.”
What Cher actually said was “Fuck ‘em,” while Bono gave a “Fucking brilliant.” Neither of which, to be sure, carried a sexual conotation. Unless, of course, what Cher meant to say was “Strap on a dildo and plow ‘em through the night” or Bono tripped over saying “I fucked a valedictorian, I love screwing those smarties” and went for the shorter version instead.
