Even though Jay Smith is facing deportation, Ashley Martson is taking her own steps to separate herself from her husband.
She has filed to divorce him.
While she did that once before and withdrew it just 11 days later, it looks like this time, she’s playing for keeps.
What’s more is that Ashley confirms, in court documents and on social media, a couple of things that worried fans have suspected.
The 90 Day Fiance star confirms the reason that she is seeking a divorce in the documents, and it is very specific.
But it was in a public reply to Jay’s sister that Ashley dropped her biggest bombshell yet.
It is SO over!

Guess who totally ruined a good thing for himself!
Jay Smith apparently did, though Ashley did not directly say “cheated” in this Instagram Story shared last week, fans read between the lines. What was obvious is that she was furious with Jay and that they were at least in a major relationship rough patch or even the end of their marriage.
Then, her single status was confirmed
First, Larissa Lima referred to Ashley as being single, and Ashley confirmed it — making a cute reference to Larissa’s most famous line: “Any who is against the queen will DIE!”
Fans sent Ashley love and support
She thanked them, but more than once, Ashley made it clear that fans do not yet know the whole story about Jay’s cheating.
Which brings us to these divorce documents
90 Day Fiance blogger John Yates got a hold of these document photos (our guess is, snapped by Ashley herself) and shared them with the world.
The papers are very fresh
Filed on Tuesday of this week, Ashley is seeking a divorce from Jay Smith. Notably, she is listed as “Ashley Smith” for the moment.
It’s not clear if Jay has even seen these, yet
It can take days or longer to serve someone with divorce papers. (Remember how difficult it was for Danielle Mullins to serve Mohamed Jbali with papers a couple of years ago?) Though, if Jay is still living on Ashley’s dime and driving her car, she may have an easier time finding him. For all that we know, he may still be sleeping at her house. Can you imagine?

But the final page drops a bombshell that confirms what Ashley has been hinting since her furious post about Jay being “canceled” over a week ago.
This is where it gets really interesting
Note here, on page five, when Ashley makes things clear: “Defendant committed adultery during the course of the marriage.”
He famously cheated before
Last summer, just days after their wedding in Vegas, Ashley caught Jay video chatting with another woman. He had downloaded Tinder and was talking to this other girl — who had no idea that he was married — about meeting up.
Ashley let that slide
She was mad, sure, but since he hadn’t actually gotten to do any banging, Ashley figured that it was worth a shot to keep Jay around.
For a while, things seemed so good
Despite their fraud scandal, Jay was by Ashley’s side.
This isn’t Ashley’s first time filing for divorce, though
Remember back on January 11, when both Ashley and Colt happened to file for divorce on the exact same day? Well, Ashley, at least, took it back about a week later.
Things seemed nice after that
In fact, Jay was reported waiting on Ashley hand and foot as she recovered from her second hospitalization.
Was that when he cheated?
Maybe while his hands and feet were busy catering to Ashley, other parts of him were doing other things with other people.
Jay already has a court appearance coming up
Jay received a letter from Homeland Security, saying that he had overstayed his K-1 visa last year. Apparently he also received a visit from ICE back in February.
Did somebody screw up?
It’s not clear if Jay dropped the ball, Ashley dropped the ball, or if they did everything right but some paperwork was either rejected or got lost in the mail. It happens, and people’s lives can be turned upside down because of it.
Apparently, this was a shock to Jay’s sister
“Are these true?” Jay’s sister asked, and actually got a reply from Ashley that seem to lend weight to things that were previously only rumors.
Ashley’s response is a big deal
“Call your brother?†Ashley suggested. “Did he not tell you he has a whole new family?” That sounds an awful lot like he knocked up a side piece.

Jay has a hearing very soon
His deportation hearing will be on May 8. And it doesn’t sound like Ashley will be fighting on his side.
In fact, Ashley has other plans
Are we supposed to believe that it’s a coincidence that she’s looking to hire a male model on May 8? We have no idea what she intends, but we cannot shake the image of her walking into the courtroom gallery beside a ludicrously handsome man who is clearly just there to make Jay jealous. Which is silly, in part because Jay can see her Instagram Stories just like anyone else.
A 90 Day Fiance shocker?
Well, no. Like we said, Ashley was dropping hints that he’d been doing some extramarital boning.
It may be even worse than that
See, a woman claiming to be Jay’s side piece took to social media to announce that not only had she been boinking Jay, but that he had knocked her up — with a Jay baby (or “Jayby,” as no one is calling it) expected to be born in October. That is, of course, unconfirmed.
Maybe we’ll know more very soon
90 Day Fiance: Happily Ever After? premieres on Sunday, April 28. While it was filmed months ago, some reality shows allow stars to give updates. Also, we’re not sure of the precise date on which the Tell All Special was filmed. Some prelude to this cheating drama may make its way onto the show.
In the mean time, most folks are Team Ashley
It’s not like it’s her word against Jay’s, because he’s not exactly running through the streets insisting that he’s innocent. Also, he cheated last year and admitted it on television. ALSO, the Happily Ever After? teaser appears to show Ashley being warned that Jay may be cheating again, though that was filmed months ago.
Whatever, Ashley has her own life
Among other things, she’s a devoted mother who has taken great pains to shield her children from the level of fame that can plague some children who appear on reality television.
Still, this whole situation is effed up
Cheating is a choice, and it’s unclear why someone would make it again and again, especially when it’s clearly against his own interests.
So it’s finally over, right?
Some wonder if Ashley will once again take Jay back, like she did the last time that she filed for divorce. We suppose that it’s possible, but given her very public tone (and her hints that there’s more to the story than even rumors suggest), it doesn’t seem likely. Jay’s luck has run out.
