After Ashley Martson accused Jay of cheating on her again, she taunted that he would be deported.
She wouldn’t be the first bitter, cheated-on spouse on 90 Day Fiance to say that about her husband.
But it turns out that she was very serious.
Documents from the Department of Homeland Security show that Jay Smith is ordered to attend a deportation hearing very soon.
In fact, Ashley says that they were visited by ICE.
This goes way beyond cheating, folks, and the timeline doesn’t add up for this being over the two getting a divorce.
Based upon the dates listed on the warrants, some fans are wondering if Jay and Ashley never actually gotten married.
Goodbye, Jay Smith
At least, that’s how things are looking at the moment. Fans may be sorry to see him go, but it’s not clear how much Ashley will miss him — if at all.
Just over a week ago, Ashley shared this
She certainly suggests that she’s pissed with Jay and that he may have cheated on her again.
That wouldn’t be unprecedented
Even before Jay came to the US, he had a reputation for being extremely horny — and Ashley’s friends made it clear that they were concerned that he wasn’t going to stay faithful to her.
Sure enough, he cheated
Just days after their wedding in Vegas (a wedding now called into question), Ashley caught Jay video chatting with a girl he’d met on Tinder — which he’d also downloaded after their wedding. But Jay is hot and Ashley is both responsible and forgiving by nature, so they stayed together.
Ashley suggested that he cheated again
And a woman claiming to be Jay’s side piece took to social media to claim that she is pregnant with Jay’s child and due in October. Yikes, yikes, yikes.
But is there more to that story?
This week, Ashley has been dropping multiple hints that fans don’t know the whole story. How much worse than these reports of cheating could it be?
Well, for starters, there’s this
90 Day Fiance blogger and unsung hero John Yates shared a couple of snaps of what appears to be an immigration warrant from the Department of Homeland Security.
It’s for Jay
The documents address Jay by his real name, Conroy Smith. It’s a Notice To Appear, claiming that he overstayed his 90 day K-1 visa. Considering that fans saw them get married, that’s a bit of a shock.
So … what happened?
An immigration attorney explained on social media that it may be that Ashley and Jay did get a legal marriage, but didn’t file the follow-up paperwork to inform DHS that they had tied the knot. So no spousal visa for Jay and no Green Card.

Jay has a hearing scheduled for May 8.
It doesn’t sound like Ashley will be cheering him on
Things have gone south between them, whether it’s because of cheating or something else. How can we be so sure?
Ashley is already shopping for a new man
Specifically, a male model. It doesn’t sound like she’s trying to set up a date for herself, but if you notice the details, she’s looking for one such hot dude on May 8 of this year — the same date as Jay’s hearing.
But there’s more
See, John Yates notes that Ashley recently revealed that ICE had visited her home — all the way back on February 4 of this year. So they’ve known that they’re in trouble for a while, now.
Coincidence? Probably not
We can’t shake the image of Ashley showing up at Jay’s hearing with a fake date. It’s an objectively funny concept, especially since Ashley is putting out feelers on Instagram where Jay can presumably see it. Pettiness goals.
And Ashley had her second hospitalization
Jay waited on her hand and foot during her recovery, and they really seemed to be in a good place.
So …
There has to be more to this than paperwork. Ashley’s pissed at Jay now, but if he forgot to mail his own papers or something last June after they married, she’d have been furious since February, if not before.
Also, this may even be her fault
It would probably be Ashley’s responsibility, legally speaking, to submit Jay’s change-of-status paperwork. Just having a legal marriage does not magically make someone a citizen or even legal resident.
Did he cheat (again)?
Ashley has been playing coy ever since her first angry post last week, and continues to tell fans (even as she thanks them for their support) that they don’t know everything that’s going on.
Until recently, things seemed good

Ashley and Jay weathered their fraud scandal together without a hint that Jay might get shipped back to Jamaica.
She actually had a (brief) feud

A few days ago, her Happily Ever After? castmate Nicole Nafziger appeared to shade her, and Ashley SNAPPED at her over it.
The two made nice and Ashley apologized
She says that Nicole even helped to talk her through this rough time that she’s experiencing.
Ashley also said fans will sympathize with her
That seems to indicate that whatever is happening is not her fault, since she believes that if (or when?) fans knew the whole story, they’d take pity on her.
So is Jay the bad guy?
Ashley certainly seemed to be furious with him when she taunted him about his upcoming deportation and exposed him for allegedly going to strip clubs in her car (without a license) and spending her money.
But maybe it’s more complicated than that
There is still so much that we don’t know, including what paperwork was filed (or rejected) when
Jay wouldn’t be the first star to have paperwork troubles
As you may recall, Mohamed Jbali is living and working in Texas, but at one point feared deportation because the paperwork that he mailed had been lost. (That situation appeared to be resolved before it became too serious)

But Ashley says that she can’t tell fans what’s happening. Maybe it’s a 90 Day Fiance thing, even though they finished filming Happily Ever After? months ago.
Or maybe …
Perhaps Jay’s attorney has instructed them both to not discuss any details on social media. That’s very good advice, since social media posts can absolutely be used against you in court. Don’t talk about ongoing cases that involve you. Ever.
Will we ever know the truth?
Probably. Let’s be real — Jay and Ashley are good at having secrets, but don’t appear to be adept at keeping them for long. And if Jay’s alleged lovechild is born this fall, well, it’s hard to keep a whole baby secret, especially when the mother doesn’t care who knows that she was banging another woman’s husband.
