90 Day Fiance fans had a bit of a fright this week.
Ashley Martson and Jay Smith shared new wedding photos, and fans feared that they’d renewed their vows.
While the context was explained, we had other and frankly more pressing concerns.
Jay had a court date scheduled for the very same day.
But he spent what must have been all day snapping photos in fancy outfits alongside his ex.
Did he just ghost the Department of Homeland Security by skipping out on his deportation hearing?

We’ve asked this question multiple times as he’s been accused of cheating on Ashley repeatedly, both before and during their marriage.
This time, it’s about this
On Wednesday, May 8, Jay and Ashley posed for an elaborate, lengthy photoshoot of the two of them getting married. Their outfits and the venue and backdrop were all breathtaking.
Fans found it a little confusing
Ashley filed to divorce Jay just weeks ago, citing adultery. Of course, she’d ALSO reportedly filed on January 11, only to take it back 11 days later. Had she lost her senses to give him what, by our count, may have been a FIFTH chance?
But there’s a larger issue
Reports circulated that Jay had been summoned to appear in court for a deportation hearing. Specifically, on May 8.
See, he had overstayed his visa
On 90 Day Fiance: Happily Ever After? we saw Ashley explain that she hadn’t filed some additional paperwork to change Jay’s status because, after he cheated on her right after the wedding, she had doubts as to whether the marriage would last. But his K-1 visa is only good for 90 days.
To clear things up, Ashley held a Q&A
She fielded a slew of questions, a few of which really stand out.
First and foremost
A NUMBER of people seemed confused by Ashley and Jay’s “wedding” photoshoot. Folks, it was arranged nine months ago and was a paid gig. She explained this at the time and she doesn’t want to keep repeating herself.
So who’s her new man?
Appaently, there isn’t one. Ashley admitted a couple of weeks ago that she had dipped her toes back into the world of romance, but clearly, nothing is serious just yet.
So … what was Jay’s plan?
According to Ashley, he didn’t appear for the hearing because it was handled outside of court.
What does THAT mean?
Sometimes, lawsuits are handled outside of court and dropped by both parties. You can’t just shake hands with Homeland Security and drop some cash to get them to not deport you.
It looks like Ashley fixed it
Maybe she filed some paperwork late, or maybe she had really filed paperwork on time and was able to clear things up with the court. Either way, Jay didn’t blow off his hearing — it had already taken place.
And there was no hearing
Starcasm did their due diligence and contacted the courthouse, who confirmed that Conroy Smith — Jay’s birth name — was not on the docket on Wednesday the 8.

That’s a social security card
Unless Jay was staging the photo to mislead his followers, that would seem to indicate that he is here for the long haul.
Here, but not with Ashley
Ashley kicked him out of the house weeks ago, and though she initially said that she had no idea where he was living, she later stated that he was residing in her hotel.
She feels responsible for him
When you sign the paperwork for someone, you’re their sponsor — something that Ashley’s castmate, Colt Johnson, never seemed to understand. Ashley took that very seriously, and despite all of the bitterness, knows that she’s the one who brought Jay to the US.
One quick note, however
You can actually get a social security card even with your K-1 visa. So it’s possible that Jay could already have had it since last year. That said, the way that his wallet is posed, it seems pretty clear that he was eager to show it off to fans. He meant for it to be seen.

Despite all of their drama, Ashley and Jay know how to keep SOME details of their lives to themselves. Some of their story will become clearer on 90 Day Fiance. Other details will come to light on social media. If Jay’s Instagram posts suddenly start coming from Jamaica, well, we’ll know that his status has changed.
