Lindsay Lohan was assaulted early Sunday morning by Christian LaBella, a man she met at 1 Oak nightclub and invited back to join her and a few friends at her Union Square W Hotel room in Manhattan.

When Lohan discovered that LaBella had been taking cell phone pictures earlier in the evening and sending them to his friends, she asked him to delete the images. He refused and she took the phone from him at 4:30 a.m. He threw her on a bed and an altercation ensued that left her with scratches on her hands.

The fight spilled out into the 15th floor hallway where Lilo pulled the fire alarm as she was reportedly being chocked.

Police questioned the ‘Liz & Dick’ actress and arrested Christian LaBella, 25, of Valley Village, California. They charged him with two counts of misdemeanor assault and harassment.

Lohan’s publicist Steve Honig issued this statement: “Lindsay was assaulted early this morning in a New York hotel. While she did sustain some injuries, she was not hospitalized. The assailant was arrested and is currently in police custody. Lindsay has spoken with police and is fully cooperating with the investigation.”

LaBella is the nephew of comedian and writer Heather McDonald of ‘Chelsea Lately’ fame.

According to NY Daily News, LaBella works as a staffer for Congressman John Shimkus, R-Illinois. His office issued this statement: “While no one from Congressman Shimkus’ office has been contacted by Mr. LaBella following his arrest, he has been an employee in the Congressman’s Washington office. Obviously, the Congressman does not condone his actions.”

UPDATE: Police have dropped the assault charge against the accused after determining that there wasn’t enough evidence to support Lohan’s claim. A police official reports, “In the wake of the investigation by detectives, we anticipate cross complaints for harassment.”
