Lindsay Lohan lost her court “battle” against Pitbull yesterday when a New York federal judge sided with the rapper that the use of her name is a 2011 song was no big whoop.

The actress filed a lawsuit against Pitbull, Ne-Yo, Afrojack, J Records, Sony Music Entertainment, RCA Music Group, Polo Grounds Music and other related parties associated with the song ‘Give Me Everything.’ The offending lyric according to court documents were: “I got it locked up like Lindsay Lohan.”

Lohan’s legal filing stated Pitbull and company did not ask permission or negotiate compensation for the use of her moniker. She was also seeking damages for the emotion distress that the negative connotation that the lyric “locked up” caused her.

A federal judge dismissed the case, ruling that the tune’s lyrics were protected by the First Amendment, which covers freedom of speech and creative expression.

Pitbull’s lawyer said after the ruling, “My client wasn’t shocked, but was disappointed when Lohan first sued in August 2011. He is now very pleased. He felt it was very important to address this head on to protect his right and the rights of other artists. He decided to fight this.”
