Jon Gosselin is preparing for a custody fight. The father of eight is not happy with what Dancing With the Stars is doing to his children and wants to request primary physical custody and spousal support. According to Jon’s new lawyer Anthony F. List, Kate is an absentee mom and the $20,000 a month that Jon is required to pay is ridiculous.

Kate Gosselin’s lawyer Mark Momijan was quoted as saying, “We haven’t received any formal filing yet but I can’t imagine anything farther from the truth. Kate is a devoted mother. Her concern for the welfare of her kids is so prominent that any allegations like this report are reckless and so far from the mark, it’s offensive.”

Jon may not have to file for custody — after Kate’s performance this week on Dancing With the Stars, she may very well be headed back to Wernersville, Pennsylvania for good. Word has it she is planning to begin promoting her latest book “I Just Want You To Know” after the dust has settled from her Hollywood gig.

Kate even had a diva meltdown last week behind the scenes of DWTS, shades of the old Kate we were accustomed to on TLC.

Ex-hubby Jon’s biggest beef has been the fact that Kate hasn’t expanded his court ordered visitation schedule during the days she spends in California each week. He wanted to be their caregiver during her absence and pay less in child support. Kate’s preference has been to leave the kids in the care of the trusted nanny.
