Walmart is pinning the blame for the car crash that nearly killed Tracy Morgan on the actor himself, saying Morgan was not wearing a seatbelt and is thus at fault.
Morgan’s lawsuit says that the corporation should have known that its driver had been awake for more than 24 hours before the fatal crash occurred.
The driver was overworked, overtired and asleep at the wheel, the actor’s camp says, and therefore the company is negligent and liable for punitive damages.
The accident took the life Morgan’s friend James McNair, while Morgan himself was in dire condition after the collision and spent several weeks in rehab.
Walmart, however, says that the tragedy was caused “in whole or in part” by their “failure to properly wear an appropriate available seatbelt restraint device.”
That, the retail giant says, constitutes unreasonable conduct – on their part. A lawyer representing Morgan called that assertion “surprising and appalling.”
