Sara Evans and her ex-husband Craig Schelske went through a very nasty breakup in 2006. The divorce decree named the country singer the custodial parent but that could change if he has his way in court.

According to TMZ, Schelske is raising an emergency red flag in an attempt to keep her from taking the kids on a cross country tour.

The three children, Avery Jack, 11, Olivia, 8, and Audrey, 6, are slated to travel with Evans when she kicks off an extended summer tour with Rascal Flatts beginning in May.

Schelske filed papers Wednesday in Tennessee in an attempt to get his visitation rights elevated to a 50/50 custody arrangement.

In order to sway the judge, he has alleged that he “has first-hand knowledge that the children are exposed to inappropriate conduct, spend little time with Sara, and are placed in a party atmosphere with excessive drinking and drug use.”

He went so far as to suggest that his ex-wife “encouraged and condoned underage drinking.”

Evans’ seven band members include two of her sisters and a brother. They all travel with their children, often parading the entire group out on stage for folksy introductions.

Evans married radio show host Jay Barker in 2008. He and his five children reside with Evans and her trio of kids in Mountain Brook, Alabama.
