The faltering John Travolta sexual assault and battery case will move forward with Gloria Allred representing the masseur referred to as John Doe #1.

Last week L.A. attorney Okorie Okorocha dismissing a lawsuit against Travolta after learning that his client, John Doe #1, gave the incorrect date of the alleged assault.

Allred stated: “I represent John Doe #1. Mr. Doe’s lawsuit was dismissed without prejudice which means that he is still legally entitled to file another lawsuit against John Travolta if he chooses. We are in the process of conferring with him regarding the next steps, which he may wish to take. Our client and our firm has no further comment at this time.”

Travolta’s attorney Marty Singer provided proof that Travolta dined in New York City on the date of the alleged assault. The accuser now claims that Jan. 16, 2012 was a “miscalculation” and recalls that the incident happened a few days earlier.

Singer and Allred have previously butted heads in the Tiger Woods vs. Rachel Uchitel debacle.

Legal eagle Okorie Okorocha will continue to represent the more credible John Doe #2.
