Variety is reporting that a federal judge has paved the way for Warner Bros. to release The Hangover 2 on Thursday, as previously planned.
S. Victor Whitmill was seeking an injunction to stop the movie from releasing, based on an assertion that a facial tattoo worn by actor Ed Helm violated a copyright of a tattoo that Whitmill created for Mike Tyson.
U.S. District Court Judge Catherine D. Perry ruled in favor of Warner Bros. The studio released the following statement: “We are very gratified by the Court’s decision which will allow the highly anticipated film to be released on schedule this week around the world.”
“Plaintiff’s failed attempt to enjoin the film in order to try to extract a massive settlement payment from Warner Bros. was highly inappropriate and unwarranted.“
The case has not been thrown out. The judge will allow Whitmill to proceed, on an expedited basis, on the question of copyright infringement. She will consider a request for a permanent injunction in the coming weeks or months — but would not agree to delay the film’s release.
Mike Tyson appeared in The Hangover and will reprise his role in the sequel.
