Tracy Morgan, still recuperating from injuries suffered in a horrific car accident last month, has filed a lawsuit against Wal-Mart.

The crash took place on June 7 and also took the life of Morgan's good friend, Jimmy McNair, who was riding with the comedian and others in a limo on the way home from a show in Delaware.

Wal-Mart driver Kevin Roper had allegedly been awake for over 24 hours when he lost control of his vehicle, leading to a six-car pile-up.

The legal papers were filed in the U.S. District Court in New Jersey on behalf of Morgan, McNair’s widow and comedian Ardie Fuqua and Morgan’s assistant Jeffrey Millea (also injured in the crash).

Kevin Roper has quickly become famous for all the wrong reasons.

The Walmart employee was behind the wheel of his truck early Saturday morning when he allegedly fell asleep and instigated a six-car accident that placed Tracy Morgan in critical condition.

It also killed 63-year old Jimmy McNair, resulting in a vehicular homicide charge for Roper.

The driver is now free on $50,000 bail and just took to Twitter to express how "horrible" he feels about the tragedy.

But Roper also denies reports that he had been awake for 24 hours prior to the crash, adding that he doesn't deserve to be facing any charges whatsoever.

Remember Tracy Morgan's homophobic rant earlier this year? No?

Well T.I. does, and he thinks it was hilarious! The rapper brought the scandal back to life when he told Vibe that Morgan's anti-gay jokes were the funniest of all time.

The comments have Morgan toeing a fine line between staying under the radar and distancing himself from T.I., who's reveled in "the funniest jokes I ever heard."

T.I. then ignited even more controversy. Not only does he find the anti-gay humor funny, he suggested that the backlash against Morgan's stand-up is un-American.

"They're like, 'If you have an opinion against us, we're gonna shut you down,'" T.I. told Vibe. "That's not American. If you're gay you should have the right to be gay in peace."

"If you're against it, you should also have the right to be against it in peace."

The rapper, who was recently freed from jail, later walked that last part back somewhat, saying that gays are not anti-American, but the actions of a select few are.

“I believe you have the right to do whatever you want to do as long as you're not hurting anyone. I was quoted correctly, but I was taken out of context,” he said.

He says the U.S.A. is an "institution built around allowing us to speak peacefully and respectfully in opposition of any point or any topic that comes up,” T.I. added.

He went on to add that he's not even against same-sex marriage, and that members of the African-American community acts in the same, oversensitive way as well.

Fair enough, but is what Morgan said, which was borderline hateful, really peaceful or respectful? And would T.I. react the same way to N-word-laden rants? Just curious.

Tracy Morgan is beloved by millions for the crazy things he says on 30 Rock and in real life. But has the comedian gone too far?

During a performance last Friday night in Nashville, the actor went off on the gay community. It would be one thing if he had original, funny jokes to crack, but it's unclear where the humor was meant to lie in the following statements:

  • "Gays need to quit being pussies and not be whining about something as insignificant as bullying.
  • "Gay is something that kids learn from the media and programming."
  • My son "better talk to me like a man and not in a gay voice or I'll pull out a knife and stab that little n-gger to death."
  • "I don't "f*cking care if I piss off some gays, because if they can take a f*cking dick up their ass... they can take a f*cking joke."
