Tom Cruise and Katie Holmes have already settled their divorce out of court, according to reports, heading off a potentially costly and public battle.

Katie's lawyer, Jonathan Wolfe, told TMZ just moments ago that it's a done deal: "This case has been settled and the agreement has been signed."

"We are absolutely thrilled for Katie and her family and we are excited to watch as she embarks on the next chapter of her life."

Wolfe added, "We thank Tom and his counsel for their professionalism and diligence that helped bring about this speedy, amicable resolution."

Tom's lawyer, Bert Fields, also adds, "The case has been settled with a signed agreement ... Tom is really pleased we got there, and so am I."

In the last few days lawyers for both sides began quietly negotiating a legal settlement and trying to end what began as a bitter divorce war.

The one condition Tom had for settling out of court was "meaningful, significant" contact with daughter Suri, now 6; presumably he got it.

What that means in terms of legal custody is unclear. Katie filed for sole custody when she blindsided Tom with divorce papers in late June.

The couple had a prenup, so Katie's financial share was likely established before the lawyers even got together; Suri was the focal point here.

More details to follow when they become available, but we're happy for all. Even if the marriage didn't work out, the split could've been worse.

Suri Cruise likely holds the key to divorce settlement talks between Tom Cruise and Katie Holmes, even if the six-year-old has no idea of this fact.

Lawyers for both sides are trying to work out a settlement that would avoid a costly, ugly, protracted and public court dispute between them.

Custody of young Suri could make or break that deal, as Tom insists any deal offers him "meaningful, significant contact with his daughter."

One source put it, "She is the primary concern in his life."

Katie filed for sole custody in June, reportedly prompted by fears that Tom's Scientology beliefs would become a central component of her life.

Tom's people have disputed this, albeit without really elaborating.

Regardless, Holmes' camp reportedly has assured Tom he will be able to spend time with his daughter when he finishes his new movie shoot.

Lawyers for both sides met for a full business day on Saturday, working on not just a temporary stopgap but a settlement for the divorce.

Attorneys are negotiating custody, visitation, support and property settlement, and while the tone has been "calm," things are still in flux.

In other words, a deal could get done, or talks could break down at any time. But for the moment, no one is rushing to the courtroom.

Lawyers for Tom Cruise and Katie Holmes are working to hash out a settlement in their divorce case in hopes of avoiding a protracted, public battle.

Quite the contrast from Kris Humphries, who's been fighting Kim Kardashian tooth and nail almost a year later ... and getting Myla Sinanaj pregnant.

Anyway, back to the topic at hand. Lawyers on both sides are in talks to negotiate a prompt, amicable and private Tom Cruise-Katie Holmes divorce.

"Neither one of them wants this to be hashed out in public," says a source.

Holmes's visit comes after Cruise attorney Bert Fields spoke to the BBC about his plan to let the other side play the media before filing a response.

"Tactically we can't say where Tom will file a divorce case and if he'll be seeking joint custody of [six-year-old daughter Suri Cruise]," said Fields.

Sources say the lawyers are negotiating child custody, visitation, child support and a property settlement between the couple, which has a prenup.

The whole settlement could be ratified in New York if all goes well, preempting a rumored move by Tom's camp to transfer the case to California.

Here's hoping they get it done for their own good, and their daughter's.

Tom Cruise has remained conspicuously silent throughout the pandemonium surrounding his impending divorce from Katie Holmes, who filed last week.

According to reports, that is 100 percent by design.

The star's lawyer, Bert Fields, says Tom is planning to file as well, but has opted to let his estranged ex "play the media" before making any legal move.

"Tactically we can't say where Tom will file for divorce and if he'll be seeking joint custody of Suri," Fields said, adding, "We are letting 'the other side' play the media until they wear everyone out and then we'll have something to say."

Although it appears a contentious battle over custody for 6-year-old Suri looms ahead, Fields reiterated that Tom is disheartened by the turn of events.

"It's not Tom's style to do this publicly," Fields said, alluding to the Scientology rumors from Katie sources and Tom's reported attempts at reconciliation.

"He is really, really sad about what's happening."

Holmes, 33, filed for divorce June 28 in New York City and is seeking sole custody of Suri. Speculation has been mounting that Cruise is planning to file a counter divorce case in California and seek joint custody, but as of yet, he has not.

The opening salvo comes July 17, when Holmes' camp is set to appear in front of a family court judge in NYC, presumably to request a speedy temporary order granting her sole custody before Cruise's legal team has a chance to respond.

Katie Holmes may say her decision to divorce Tom Cruise is over Scientology, but sources close to the actor says it's not and she's motivated by something else.

What, they won't say. Yet.

A source close to Cruise tells TMZ that Holmes' camp is leaking false stories to the media claiming she's trying to save Suri from the grips of Scientology.

But, as the well-connected Tom source put it, "She [Katie] was totally committed."

"She had a great enthusiasm for Scientology and would voluntarily and gladly participate in it, including when Tom was off shooting movies."

"This is not a fight over religion. It's being used as a way to hurt Tom."

It's possible, of course, that Katie was committed to it because it was important to Tom, but soured on it of late because of Suri, as reports claim.

Still, Cruise sources claim Suri is being used as a weapon against him and that his now-estranged wife is making it very hard for him to talk to her.

Katie Holmes covers the new issue of Elle, and you can't help but read into some of her quotes knowing she was about to file for divorce from Tom Cruise.

Perhaps most notably: "I definitely feel much more comfortable in my own skin," the actress, 33, says of having progressed in her 30s. "I feel sexier."

She goes on, "I think in my twenties – it’s like you’re trying too hard to figure everything out ... I’m starting to come into my own. It’s like a new phase."

On the subject of being Mrs. Tom Cruise, which she apparently had enough of just weeks after giving this interview, she also hints at the breakup.

"He has been Tom Cruise for 30 years," she says. "I know who I am and where I am and where I want to go, so I want to focus on that."

As for his impact on her own career: "Things are not handed to anyone. If anything, you work a little bit harder when you’re in such visible circumstances."

Who knows if it means anything, but the NY Post says Katie did not enjoy speaking about Tom, who allegedly begged for reconciliation and is very bitter at her.

“Katie didn’t speak about Tom in a lovey-dovey way at all" in the interview. "She deflected the Tom questions and brought them around to herself.”

Tom Cruise is reportedly bitter at soon-to-be-ex Katie Holmes for not only blindsiding him with divorce papers last week, but for using their six-year-old daughter Suri as a weapon against him in the proceedings, according to reports.

The two are no longer on speaking terms as a result.

Although Tom now has "absolutely no contact with Katie," his people are negotiating with Katie's people over when and how Tom can talk to Suri Cruise, and Holmes' people are allegedly making that difficult for him.

The 50-year-old movie legend does speak with his daughter by phone at least once a day, TMZ sources say, but note that it hasn't been easy to get that.

When Tom does get Suri Cruise on the phone, he has not discussed the breakup of his marriage with his daughter. Nor does he know when he'll see her.

Things are "really bitter now" between Tom and Katie, people close to the situation say. He feels betrayed and thinks she is "using Suri as a weapon."

Whether she's being used as a weapon or not is subject to debate; fears over how she will be raised are legitimate, and are said to have prompted her to leave Tom.

You can bet that the Tom Cruise-Katie Holmes divorce will remain contentious if she continues to seek sole custody and limit his exposure to Suri.

It's safe to assume Tom Cruise's 50th birthday was not what he'd hoped for.

According to Us' cover story (below), he traveled from Iceland, where he's been shooting the new film Oblivion, to the United States early July 3.

If things had gone according to plan for Cruise, he'd have celebrated hitting the half-century mark in Iceland with wife Katie Holmes by his side.

But since Katie filed for divorce out of nowhere last week, he was forced to make a last-ditch effort to save the relationship, only to be rebuffed.

While Holmes, 33, was MIA from Rock of Ages premieres and other events, "he begged her to come to Iceland for one last try at reconciliation," the insider says.

Holmes, motivated by fears of Scientology corrupting their daughter Suri, had been secretly plotting to file for divorce and move into her own NYC apartment.

She refused to go, and the pair had a "huge fight," the source explains.

Although Cruise was aware that things were tense and severely estranged with Holmes, "he was confident he could talk her out of it and keep her with him."

Holmes seeks sole legal custody of Suri, 6, and clearly filed in N.Y. State as a means of achieving that goal, as its courts are more likely to award sole custody.

There's a prenup in place, but regarding custody, it looks like a nasty split is on the horizon. Here's hoping they can work it out quietly and under the radar.

How much will Katie Holmes get in her split from Tom Cruise?

That depends on a number of variables, but the prenup she signed in 2006 basically cuts her out of the vast majority of her fortune, according to reports.

One source calls the prenup she signed "long, tight and stacked in Tom's favor." Not that she minds. She just wants freedom for herself and her daughter.

A source close to Cruise says reports that she will receive $3 million for every year they were married are false, and that she will receive next to nothing.

At the same time, "She's not about the money. She's not that girl. She loves to work. Money is not that important to her. She makes plenty on her own."

A major sticking point in the Tom Cruise-Katie Holmes divorce - besides custody of Suri - may be child support, which she reportedly wants from the star.

As for whether Katie will challenge the prenup, it's pretty common when a divorcing couple is in conflict, though it's unclear on what grounds she'd contest it.

There's a potential custody fight over Suri Cruise on the horizon, but when it comes to Tom Cruise's older kids, the ties that bind seem to be tight ones.

Isabella and Connor Cruise, his two adopted children with ex Nicole Kidman, have so far remained mum on the impending Tom Cruise-Katie Holmes divorce.

But Connor seems to be weighing in, subtly, taking to Twitter to allude to the news: "#LaFamilia Always. Friends Come And Go, But Family Is Forever."

Connor Cruise, 17, is especially tight with his dad. These last few weeks, he was on hand as Tom received the Friar's Club's Entertainment Icon Award.

The 33-year-old Holmes, who is reportedly seeking sole custody of Suri, 6, has been close to her stepson and stepdaughter since marrying Tom.

Holmes has hunkered down in NYC following the split, amid speculation that his commitment to Scientology played a role in the relationship's demise.

Cruise, who's been on location in Iceland filming the sci-fi flick Oblivion, has just hired Dennis Wasser to represent him in the divorce battle ahead.

That's the same attorney who handled his divorce from Kidman in 2001; He and Nicole, who is re-married to Keith Urban, remain on good terms.
