The Sheriff's Department's investigation is over, but sources say the Mel Gibson case is not heading toward a resolution, or even a decision on charges, soon.

The L.A. County D.A. will not make a quick decision on whether to charge Mel and/or Oksana Grigorieva with a crime, at least not this week. TMZ reports.

The reason? This is a really, really complicated case!

It's unclear if either Mel or Oksana will be charged.

The L..A. County Sheriff's Dept. turned over a full report on the Oksana Grigorieva extortion investigation. There are two separate investigations in play, too.

Because of the alleged extortion, the Mel Gibson tapes, her accusation of domestic abuse and myriad custody issues, the report will take time to digest.

The D.A. has said they will make a decision on whether to file criminal charges as a package, but that the decision absolutely will not be made this week.

After an investigation that's spanned several months, the Oksana Grigorieva extortion case is now in the hands of the L.A. County District Attorney.

The case file went to the D.A.'s office at noon today.

Some sources say a charge is unlikely, given the inconsistencies in her story and the obvious credibility problems she has amassed over half a year.

The D.A. will soon decide if Oksana will be charged with extortion.

It boils down to a $15 million deal Oksana signed, and then walked away from, during child custody mediation sessions with Gibson in May, 2010.

The deal included child support, a house, and other assets ... plus the guarantee that Oksana would NOT leak the now-infamous Mel Gibson tapes.

The D.A. has also yet to decide whether to charge Mel Gibson with domestic abuse, which Oksana alleges and the actor has vehemently denied.

The extortion investigation of Mel Gibson's ex-girlfriend Oksana Grigorieva drags on, with the case still not turned over to the L.A. District Attorney.

This has left prosecutors "frustrated" as they look to move forward with the domestic violence case against Mel and the extortion case against Oksana.

Until files are turned over, the D.A. can't file charges or drop the case.

While the investigation was said to be "substantially done" last week, prosecutors now don't think they will receive the case until next week, if that.

"The amount of hours the Sheriff's Department spent investigating Oksana is mind boggling," said one source. As is the fact that Mel ever dated her.

Sheriff's officials have spent months investigating claims that she, or someone close to her, tried to trade her silence in exchange for Gibson's cash.

The two are also in a bitter custody dispute over one-year-old Lucia.

Oksana Grigorieva’s former bodyguard Kristian Herzog has completed a tell-all book about his former employer and her explosive relationship with Mel Gibson.

Herzog, who claims he nailed Oksana, but that she basically lied about all things Mel, is now hoping he can land a book deal, and is shopping around a draft.

The convicted criminal, who was once accused of impersonating a police officer, was set to be deposed by Mel this week but postponed that due to illness.

He Looks So Normal Here

TEAM MEL: Kristian Herzog is ready to throw Oksana under the bus.

Kristian working with Oksana during a particularly turbulent time in her life - shortly after the January 6, 2010, incident in which she claims Mel attacked her.

"Kristian thinks there is a big market for a book, and he thinks he is the one that should spill the beans about Oksana and Mel's relationship," says a source.

“He is trying to do whatever he can to insert himself into this mess, and [Kristian Herzog] is adamant that he had an intimate relationship with Oksana."

Credible witness? Maybe not. Entertaining and enterprising? You know it!

Mel Gibson's legal team is gearing up to depose the rogue bodyguard who claimed he nailed Oksana Grigorieva and that she is lying about all things Mel.

The interrogation of Kristian Herzog, a twice-convicted felon is set for Friday. Accused of battering his ex, Mel wants the dirt he hopes will vindicate him.

"Gibson's camp believe Kristian will admit Oksana is exaggerating her version of events in relation to the domestic violence allegations," a source said.

Kristian Herzog (left), may be a key player in the Mel-Oksana feud.

Oksana Grigorieva has claimed the Oscar winner punched her in the head on January 6, 2010, at his mansion in Malibu, knocking two of her teeth out.

While she was holding their infant daughter Lucia, no less.

But Kristian Herzog, who has signaled a shift to Team Mel in recent weeks, may be ready to go on record saying she's a manipulative, distrustful liar.

Whether his testimony is believable itself is another story.

The L.A. County Sheriff's Department is asking the judge in the Mel Gibson case to turn over files as they scrutinize the credibility of Oksana Grigorieva.

The couple is at war over custody of Lucia, 1, and investigators want to know if - surprise - she's told conflicting stories about alleged domestic violence.

Lawyers for the Sheriff's Dept. want copy of the court file to evaluate the domestic violence case, but  the real focus is everything Grigorieva has said.

The much-disputed events of January 6, 2010 are under heavy scrutiny as officials want to look at Oksana's declaration and deposition testimony in particular.

Based on what we've reported on this case over the past six months, at least on an anecdotal level, it's hard to imagine investigators won't see inconsistencies.

Her former bodyguard's claims alone establish that she's said a lot of things over time that don't add up, but pinpointing the truth remains extremely hard.

The request could have a bearing on whether domestic violence charges are filed against Mel and whether the D.A. will file extortion charges against Oksana.

In light of the recent eye-opening statements from Kristian Herzog, Mel Gibson wants the ex-bodyguard of Oksana Grigorieva to spill it all in court.

Specifically, information Team Mel feels will paint his estranged baby mama as the liar and fraud they have been making her out to be for months now.

Mel's lawyers want Kristian Herzog to fork over every document and photo that details his relationship with Oksana Grigorieva and with her lawyers.

GIVE IT UP: Mel Gibson feels the testimony of Kristian Otto Herzong (far left) could really help him put it to Oksana Grigorieva ... in the legal sense, that is.

Gibson's lawyers also want "1000s of emails, text messages, 100s of private photos, private videos and voice mails" Herzog claimed to have a few months ago.

That's when he touted that Oksana was a victim of domestic violence. He's singing a different tune now, claiming Oksana's claims are exaggerations if not lies.

Mel's lawyers also want all emails and photos to back up Herzog's earlier claim that he was giving Oksana more than protection, if you know what we mean.

Oksana Grigorieva's ex-bodyguard Kristian Herzog has had some rough things to say about Mel Gibson in the past ... like how Mel wanted him dead.

Now, though, the guy who likely knows the most about Oksana's claims against Mel says she's exaggerating or downright lying about violence.

Derek Lowe Mug Shot

Herzog, who served as her bodyguard until recently, and who may or may not have nailed Oksana, says she admitted to him Mel never punched her.

Oksana is a manipulative liar trying to bilk Mel, says Kristian.

Rather, Herzog says Oksana told him Mel slapped her. That's it. Gibson admits slapping Oksana, claiming he was trying to protect daughter Lucia.

Herzog, who's been subpoenaed by Mel's lawyers in the couple's custody fight, also says she had a motive for secretly recording Mel Gibson rants.

That motive, simply, was "to pressure Mel to pay her money."

A new report says prosecutors are ready to file criminal charges against Mel Gibson for hitting Oksana Grigorieva, the mother of his daughter Lucia.

The L.A. District Attorney granted Gibson’s lawyer, Blair Berk, a last-ditch meeting late Tuesday, as she sought to persuade authorities against it.

OG Rollin' to Court

Deputy D.A. John Lynch met with Berk at the courthouse for close to two hours, but reports suggest charges against Mel are almost inevitable.

Specifically, the charge of domestic violence / corporal injury involving his former cohabitant is looming for the Oscar-winning actor/director, sources say.

It can be prosecuted as a felony or misdemeanor, and it's unclear which (if either) Mel will end up facing. Either way, expect a lengthy court battle.

Not to mention a mammoth legal bill for Mel.

It's also worth nothing that despite the "stunning decision" sources claim has been made in this case, Gibson has not actually been charged yet.

There are also concurrent court cases involving child custody and Oksana's alleged extortion of Mel, and how those dovetail with this is unclear.

Oksana Grigorieva is not only feuding with Mel Gibson early, often and nastily, she thinks he should be on the hook for all legal expenses therewith.

To the tune of $163,000 a MONTH.

Mel just got a legal bill from one of Oksana's vast arsenal of lawyers, Alan Shifman of the firm Dewey, Cheatem & Howe. Just kidding. Probably.

RELENTLESS: Oksana cannot be stopped in her pursuit of cash justice.

Shifman claims he racked up a $163,000 fee for work performed from October 15-November 15. Then he was replaced like the 38 before him.

Even at $600 an hour, that means he worked about 272 hours during the month, or nine hours a day, seven days a week. Not sure we buy it.

Oksana's attorneys want Mel to pay more than $1 million in legal fees overall. She's too broke to bribe a witness OR pay lawyers, apparently.
