The infamous Mel Gibson tapes are about to become irrelevant.

Oksana Grigorieva's lawyer, Dan Horowitz, told the judge in the couple's custody case this a.m. that he may not even introduce the tirades into evidence.

Oksana En Route

Horowitz backing off the tapes comes a few weeks after he told the judge that Oksana would be dropping domestic violence allegations against Gibson.

Come here often?

The Mel Gibson tapes could surface if Oksana files a civil lawsuit against Mel, but it's starting to look iffy at best that such a lawsuit will even be filed.

Mel's no contest plea to battery ended the criminal case, and Oksana's damages would be limited even if she won a civil case against him in the end.

Long story short, it may not be financially worth the trouble for her to continue this crusade. Everyone may soon breathe a sigh of relief that it's over.

Well, everyone except Kris Herzog.

In a shocking move, Oksana Grigorieva dropped her domestic violence claim against Mel Gibson at a court hearing today in the couple's custody case.

Last month, Mel pleaded no contest to battery, ending that chapter of the pair's legal circus. But the battle for custody of Lucia, 1, remains unresolved.

Moksana

In fact, it's been so contentious that today's move came out of left field, as Oksana actually extended an olive branch in an attempt to settle the case.

Oksana's lawyer, Dan Horowitz, told Judge Scott Gordon that they would no longer claim Mel's alleged violence as grounds to strip him of custody.

Mel's lawyer, Stephen Kolodny and the judge were visibly shocked.

The domestic violence protective order Oksana obtained - prohibiting Mel from contacting or harassing her - has also been terminated as of today.

Sources close to Oksana Grigorieva say she would like to be able to communicate directly with Mel, rather than going through intermediaries.

No word on whether Mel feels the same way, but it's a good first step in putting this ugly mess behind them for the good of their little girl.

The only potential bad news? Kristian Otto Herzog's book won't sell nearly as well if these two are actually getting along now. Poor guy.

Were the Mel Gibson tapes we heard last year authentic or not? It matters little from a legal perspective, but could mean plenty for the actor's reputation.

Kent Gibson, a forensic audio expert who examined the infamous 18 recordings from Oksana's computer, says the tapes are authentic - on the machine.

Mel acknowledged the tapes in an interview last week, and admitted they were a low point for him. Just the same, he said the tapes were edited.

Oksana is pissed at Mel for saying the tapes were edited, but he might be correct. The actor could have been referring to the versions that leaked online.

In other words, it's possible the recordings in Oksana's computer are legit but they were later edited at some point before Radar Online obtained them.

Nine are voicemails from Mel and nine are conversations between Mel and Oksana. All took place February 18-20 of last year, most VERY late at night.

Below are some of Gibson's rants. Do they seem edited?

In a new interview with Deadline Hollywood, Mel Gibson has finally broken his silence over the infamous tapes of him berating Oksana Grigorieva last year.

While shrugging off criticism, he takes responsibility for his behavior.

Of the Mel Gibson tapes, the troubled actor says this: "It's one terribly awful moment in time, said to one person in the span of one day, and doesn't represent what I truly believe or how I've treated people my entire life."

Angry Former Couple

Mel also stresses to Deadline that "I've never treated anyone badly or in a discriminatory way based on their gender, race, religion or sexuality."

While he says the tapes "have been edited," he doesn't blame people who think he's a bigot "from the garbage they heard on those leaked tapes."

He emphasizes the context of an "irrationally, heated discussion at the height of a breakdown, trying to get out of a really unhealthy relationship."

Perhaps this explains why Mel Gibson's mug shot painted such a grumpy, serious picture of the man this week. He's preparing for an all-out legal war.

The actor's lawyers will appear in court Monday and ask the judge in his custody battle to award him sole custody of Lucia, according to court papers.

Oksana's Loco

Mel pleaded no contest to battery last week, ending a year-long saga of nasty allegations from Lucia's mother and Gibson's ex, Oksana Grigorieva.

But that was really just the conclusion of the first chapter.

In addition to attempting to take custody away from Oksana, Mel Gibson's lawyers will ask Judge Scott Gordon to award her visitation only with a monitor.

Gibson, whose no contest plea is NOT an admission of guilt (he denies her allegations), also wants the judge to deny Oksana overnight visits with the baby.

If would appear that Mel Gibson's no contest plea to battery did not satiate Oksana Grigorieva's unrequited thirst for CA$H justice even a little bit.

Lawyers for Mel's baby mama are going after Gibson in their ongoing custody fight / family law case, asking for a hearing on whether Mel hit her.

Specifically, Oksana Grigorieva wants the court to ...

  • An order awarding Oksana sole custody of their daughter, Lucia, 1.
  • An order forcing a shrink to determine Mel's mental state (seriously).
  • A hearing to determine if Mel hit Oksana (a no contest plea isn't an admission of guilt, and he has denied the allegations of domestic abuse).

Oksana's team believes that Judge Scott Gordon may have been influenced by Mel's assertions that Oksana committed extortion with the infamous tapes.

That case has been dropped. Whether it results in an instant upgrade in custody status for her is another story, but this is destined to get even uglier.

Despite Mel Gibson's no contest plea to battery last week, Oksana Grigorieva plans to file a lawsuit alleging battery, emotional distress and defamation.

Sources close to Gibson say he will wage legal war if Oksana does so. Forget settling out of court ... it is ON like legal Donkey Kong this time around.

Oksana G.

The actor will "gladly" file his own lawsuit against the woman he says put a $15 million price on the Mel Gibson tapes in return for keeping quiet.

It could be just beginning for Mel and Oksana ...

Oksana's lawyer, Daniel Horowitz, said "our position hasn't changed" regarding Mel's no contest plea and her plans to sue for myriad damages.

This looming lawsuit likely played a huge role in Mel's no contest plea on misdemeanor battery charges, for which he will serve no jail time.

Pleading no contest subjected him to similar sentencing as a plea of guilty, but there was no admission of guilt that will bolster her claims.

Basically, he denied her account before, he's likely to keep denying it now, and Daniel Horowitz and Blair Berk are going to bill a lot of hours.

The L.A. County District Attorney filed a single misdemeanor battery charge against Mel Gibson today. The actor, as expected, pleaded no contest.

The misdemeanor specifically targets someone who cohabits or has a child with the alleged victim, but is less severe than felony domestic abuse.

Mel will not receive jail time for the alleged attack on Oksana Grigorieva, but will continue to undergo counseling and be on 36 months' probation.

One of the terms of probation - he cannot use violence against anyone. Mel may continue to have "peaceful contact" with Oksana going forward.

Mel: Troubled Fella

The nearly year-long Mel Gibson saga has come to an end.

A no-contest plea, while not technically a guilty plea, has the same immediate effect as a guilty plea, and is often offered as a part of a plea deal.

That's what happened today. While Mel felt he could win the case in court and be completely exonerated, this was his quickest means to an end.

Gibson also must perform court-ordered community service at a charity organization, and he elected to do so at Mending Kids International.

The group provides life-changing surgical care to children in need. None other than Mel's estranged wife Robyn Gibson serves as President.

Meanwhile, Oksana Grigorieva will NOT be charged with felony extortion in the concurrent investigation by the L.A. County District Attorney.

Coinciding with Mel Gibson pleading no contest to battery, the case against the mother of his child (and his domestic abuse accuser) is also ending.

The extortion investigation of Oksana Grigorieva has been officially rejected by the Los Angeles County D.A.'s Office, according to Radar Online.

The battery charge against Mel will officially be filed on Friday, at which point Mel will plead no contest and be sentenced. He will not go to jail.

The D.A.'s office will announce that the extortion case was rejected at this time, as there wasn't enough evidence to prove that a crime occurred.

"Oksana could speak at Mel's hearing Friday. She could make a victim's impact statement, but at this point, it doesn't seem likely," a source says.

Gibson will appear Friday at the Airport Courthouse in front of Judge Stephanie Sautner to receive the relatively light sentence he plea bargained.

His camp claimed Oksana tried to extort him with the Mel Gibson tapes. The investigation snapped months, but charges will now be thrown out.

What do you think? Was justice served in the case?
