Lane Garrison has just been legally ordered to stay away from his ex-girlfriend, Ashley Mattingly, which should not be a huge issue as he's in jail.

The actor allegedly slapped Ashley in the face last month during a argument at her apartment building, leading to his arrest for battery last month.

He's will plead not guilty to misdemeanor domestic violence at his court hearing, which was pushed back due to questions regarding his parole status.

Lane is currently on parole stemming from his 2007 vehicular manslaughter conviction, and has remained in custody on a parole hold since his arrest.

Lane's parole was supposed to end last Saturday, but his arrest may jeopardize that. The judge conditionally set bail at $50,000 for the troubled star.

He maintains he was only trying to grab his phone (see Lane Garrison surveillance video) and that he never actually hit is ex. Police aren't buying it.

His arraignment has been rescheduled for Friday.

Actor Lane Garrison has been charged with misdemeanor domestic violence following his alleged attack on ex-girlfriend Ashley Mattingly last week.

While it appeared Lane would be cleared as recently as mid-week, the L.A. County District Attorney filed the charges against him late Thursday.

Based on surveillance video which appears to show Lane slapping Ashley Mattingly in the face last Saturday, the D.A. felt he had a case to make.

Garrison insists he did not hit his ex, and says the tape helps his case.

Lane's lawyer says he was merely reaching for his phone at her Beverly Hills apartment and it was not a slap, but evidently the D.A. begs to differ.

Garrison is being held without bail because he's on a parole hold. He was convicted of vehicular DUI manslaughter back in 2007 and went to prison.

If convicted of domestic violence, he faces up to a year in jail, which is very unlikely, however, he could do even more time if his parole is violated.

That prospect is much more likely. Stay tuned.

Lane Garrison, who was arrested for domestic violence on Saturday, says the surveillance video of him apparently slapping his ex proves ... that he did not.

Lawyers.

The actor and his ex-girlfriend got into a verbal argument that turned physical and the surveillance video (below) showed what appears to be Lane Garrison slapping Ashley Mattingly's face hard, which he told cops never happened.

He still says that, and here's why:

Lane told Beverly Hills detectives that what really happened was Ashley grabbing his phone and him reaching to grab it back from her. No slap at all.

Lane says he ended up grabbing Ashley Mattingly's cell phone, not his own ... and that's when she threw his phone against the wall and smashed the thing.

He says when he walked out, he childishly threw her phone in retaliation. If you look at the video closely, Lane Garrison's scenario is at least plausible.

He also claims he has text messages from Ashley that are incriminating and that she didn't want him disclosing - hence the freakout over the phone.

Garrison, who is still on parole for his manslaughter DUI conviction, is still being held in connection with this case and a possible parole violation.

A new surveillance video obtained by TMZ shows Lane Garrison slapping Ashley Mattingly across the face after he waited for her outside her apartment.

Lane was arrested for domestic violence Saturday, but denied hitting his ex, saying he put his hands on Ashley's shoulders, put her in a chair, and left.

Not exactly the case, according to the surveillance video:

The former Prison Break star claimed that he ran into his ex while visiting someone else's apartment, too ... but he appears to be sitting outside waiting for her.

When Ashley drives into the building's garage, Lane is seen stumbling as he runs after her. They are then seen walking into the building together.

Clearly arguing as they get into an elevator, Ashley seems to be asking Lane to leave, but when he refuses, she gets off ... and all hell breaks loose.

Garrison says he did NOT hurt his ex, however. According to his attorney, Harland Braun, Garrison went to her Beverly Hills apartment building to dog sit for his acting coach, who happens to live in the same building on the third floor.

As he went to leave, he ran into Ashley in the lobby.

Braun says Garrison told him the two began arguing about the failed relationship, and Ashley started screaming and threw Lane's cell phone against the wall.

Braun claims that Lane then put his hands on Ashley's shoulders, put her in a chair, and then left. Lane says he did not harm Ashley Mattingly at any point.
