Gabriel Aubry could be in major trouble with the law.

The Canadian model, who shares custody of three-year old Nahla with Halle Berry, is under investigation for allegedly screaming at his nanny last week and shoving her out a door... while the woman cradled the child in her arms.

According to a police report published by TMZ, Aubry kept Nahla home from school last Wednesday, unbeknownst to the nanny. When she arrived at Gabriel's house and asked why the tyke was not in class, Berry's ex supposedly went off on her:

"You're the f*cking nanny. Who do you think you are? You are a nobody. You don't need to f*cking know anything."

He then pushed her out the door.

Gabriel Aubry has lost to his ex-girlfriend in court once again.

The Canadian model was hoping a judge would lift the ruling that obligated a nanny to be present any time he was with he and Halle Berry's three-year old daughter, Nahla. The actress had opposed such a request.

And a judge sided with the Oscar winner yesterday, upholding the original agreement between these exes for supervised visitation only. Sources tell TMZ Aubry is peeved over the outcome because he feels a lack of alone time is affecting his relationship with his child.

Berry also defeated Aubry in court this summer when a judge ruled she could bring Nahla with her on a movie shoot in Europe.

In June, Berry accused her ex of neglect. Court documents cited a specific incident in which Aubry allegedly placed the former couple's daughter in danger. No other details have been revealed.

Halle Berry won a battle in court today with ex Gabriel Aubry. But, as this custody battle rages on, it's clear who the real loser will be: three-year old Nahla.

Sources tell TMZ the former couple was in front of a judge because Berry will be leaving to film a movie in Europe and there was an issue over which parent gets to spend time with his/her daughter when Halle is working.

Berry won this round, meaning Nahla will be accompanying her mom overseas.

The issue is unrelated to a larger problem Berry has brought up to the court, however. She alleges that Aubry has imperiled the safety of their child. Many more hearings will unfortunately take place involving the family.

After a few weeks of rancor, it appeared in April as if Halle Berry and Gabriel Aubry had reached a truce in their battle over their three-year old daughter, Nahla. A custody agreement was signed.

But the actress was back in court today, claiming that Aubry violated said agreement and accusing the father of neglect.

Details are scant at the moment, but TMZ first broke the story of Berry submitting a lengthy complaint to a judge. It outlines all the ways in which Aubry - a Canadian model who split with the actress in May 2010 - supposedly violated the former couple's terms.

One incident overseas, where Aubry allegedly imperiled Nahla's safety, is specifically cited.

The judge has scheduled a hearing to hear more on the matter and we'll keep readers apprised as news breaks.

Halle Berry and Gabriel Aubry were back in court today, but unlike previous before a judge, they left having nearly finalized a custody settlement.

In a sign that their custody battle may end, Judge Mark Juhas told Gabriel and his camp, "We're making huge progress. We need to stick with it."

Halle and her lawyers, Neal Hersh and Judy Bogen, went into chambers to talk with the judge. Before that, Gabriel and his lawyers did the same.

A settlement conference over Nahla's custody and visitation is what brought them to court. The major stumbling block has been Halle's schedule.

This takes her out of town from time to time, obviously. From what happened this AM, it looks like Halle and Gabriel are on the verge of a truce.

That's a far cry from a few short months ago, when the two clashed publicly and harshly over not just custody, but their daughter's race.

So reads the custody scoreboard between this former couple, after a judge ruled in the actress' favor today and said she could take daughter Nahla to New York for a movie shoot.

Sources confirm to TMZ that these two started to fight over their child when Aubry attempted to block Berry from taking the two-year with her across the country to film New Year's Eve.

With the Oscar winner in attendance, a Los Angeles judge gave her the green light bring Nahla along for the duration of her time on set.

"We are pleased the judge took the time to deal with this very imminent and important issue," Berry's attorney, Neal Hersh, said. "The judge read a great deal of paperwork and gave us time to argue."

Man. All this over the sequel to Valentine's Day?!? Perhaps if Berry and Aubry watched that atrocious romantic comedy, the entire hullabaloo could have been avoided.

The custody battle between Halle Berry and Gabriel Aubry is growing uglier each day.

Throughout this week, sources have claimed that the model often berated the actress in despicable terms; while Berry replied by treating her child's father like a sperm bank.

At the center of this feud, of course, is two-year old Nahla. It was her reaction to spending time with Aubry in December that reportedly raised concerns for Berry.

"She was crying and kicking and screaming. She was hanging onto her mother's legs so she didn't have to go," a insider tells People of a an incident around Christmas when her dad arrived to pick Nahla up.

Gabriel allegedly responded by "forcing" his daughter into his car. Ever since, terms of the parents' relationship have gone from amicable to extremely sour.

Might a tabloid have gotten it right for once?

Late last year, reports surfaced that said Halle Berry had a major problem with ex-boyfriend Gabriel Aubry dating Kim Kardashian, especially considering how the two weren't shy about appearing in public together.

Now - as Berry and Aubry exchange insults and prepare to battle for custody of daughter Nahla - a source tells People that Gabriel's fling with Kardashian really was an issue for the Oscar winner.

"Halle was upset at the idea of someone like that being in her daughter's life," the insider said of Kardashian. "She was very aggravated... She just didn't want Nahla exposed to the cameras that are undoubtedly around a reality star."

How did Berry express her anger?

Might the public be seeing a side to Gabriel Aubry that doesn't include chiseled abs and a tush on which one could bounce a quarter?

She says "Gabriel's entire motivation has always been money... I tried to warn Halle early on, but I guess she didn't want to believe it."

Bogart has even supplied us with an anger-filled voicemail left by Aubry, who she claims had a few "Latin hoochies" on the side while dating Berry. Listen to the recording above.

Those close to Gabriel Aubry say this Canadian model has been forced to take Halle Berry to court because he fears her jealous rage over his dating life will result in less time spent with the couple's daughter, Nahla.

As reps for the two sides exchange public barbs, it's been unclear why Berry says she "has serious concerns" over Aubrey's interactions with the two-year old. Until now.

"From the beginning, Halle kind of had the upper hand because she was essentially supporting all of them for the most part. Gabriel never liked how that felt. Their split was tough because they're both so involved in raising Nahla, and neither ever wanted to give that up."
