Malcolm Ausbon, a California man, says short-fused singer Chris Brown and three members of his posse jumped him at a 24 Hour Fitness last year.

All, he says, because of a disputed foul during a pickup basketball game.

Ausbon is suing Brown, his goons and 24 Hour Fitness for unspecified damages claiming assault, battery, intentional infliction of emotional distress and negligence.

The lawsuit states that when Brown, 24, refused to acknowledge the foul called on him by Ausbon around 11 p.m., Ausbon "expressed his dissatisfaction."

Chris allegedly replied that he was a member of the Bloods street gang.

As Ausbon began to back away, members of the singer's entourage stepped in and said, "If you f--k with Chris, you f--k with us," the lawsuit states.

Chris Brown sidestepped a new effort to put him in jail yesterday when a judge rejected prosecutors' efforts to put him behind bars for a probation violation.

Judge James Brandlin said Brown appeared to be making progress in his anger management program and should remain there for the foreseeable future.

Chris Brown checked into rehab after he was arrested October 27 in Washington D.C. for allegedly punching a man in a dispute over a fan photo.

He got kicked out after throwing a rock at his mom's car, but was ordered by the court to finish a 90-day program while the assault case is pending.

Prosecutors said Monday that additional witness statements obtained last month offer "sufficient evidence" to move forward with a full-blown mini-trial.

That hearing, decided by a judge instead of a jury, could result in revocation of the singer's felony probation sentence for his 2009 beating of Rihanna.

Chris Brown appeared today inside a D.C. courtroom and - good news! - he didn't punch anyone inside.

But in even more surprising news, the singer did reject a plea bargain in conjunction with assault charges he faces after an October confrontation.

According to TMZ sources, the prosecutor told a judge that he had offered Brown a deal that would have reduced the charge to simple assault… but the artist's attorney turned it down.

It's unknown why at this time, but it is believed that Brown's lawyer has not yet been given surveillance footage from the night in question.

Chris Brown is responsible for more than $3 million dollars in pain and suffering endured by Frank Ocean's cousin, the latter says in a new lawsuit.

According to legal documents filed as a result of the massive brawl outside an L.A. recording studio earlier this year, Chris is a goon who needs to PAY.

Sha'Keir Duarte claims Chris and his fellow thugs put a hurting on him in the fight between Chris Brown and Frank Ocean and their posses in January.

Duarte claims that Brown's bodyguard specifically brutalized him, and in his court filing, he even itemizes his list of damages, complete with amounts:

  • $1,000,000 for pain, suffering and inconvenience
  • $1,000,000 for emotional distress
  • $1,000,000 for punitive damages
  • $60,000 for medical expenses

Sounds a bit high ... but that's for the courts to decide.

Brown, for his part, has already filed counter lawsuit against Duarte, accusing him of provoking the fight and attacking him with kicks and punches.

Ocean, for his part, declined to pursue the matter.

Chris Brown is out of rehab early because he was kicked out, according to a new report, and he's been ordered back for anger management treatment.

The probation report in the Rihanna assault case outlines what happened during his stint in a Malibu rehab center for anger management counseling.

About two weeks in, Chris' mom Joyce Hawkins showed up for a family session and during it, urged him to stay in the facility for extended treatment.

For whatever reason, Chris disagreed with his mom, and violently, throwing a fit - and a rock, through her car window, shattering the thing. Seriously.

Shortly thereafter, he got booted from facility following the outburst.

The report goes on to say without continued therapy and a strong recovery support network, the 24-year-old singer's prognosis is "very guarded."

Chris Brown's legal prospects are looking up if a new report is to be believed. Allegedly, the victim was overheard saying that Brown did not land a punch.

According to court documents, a witness to the fight Sunday morning told investigators that he heard the alleged victim tell a cop Brown NEVER HIT HIM.

The cop later denied speaking with the witness in question, but it gets stranger still, due to a Secret Service agent that made contact with D.C. police.

The agent told them he happened to be around when the victim told the officer that Chris never struck him. The agent says he absolutely heard the comment.

This is doubly helpful for Chris Brown, because if a Secret Service agent is willing to go out of his way to make that known, it's huge for his side of the story.

Chris Brown has checked into a rehab facility to seek treatment for anger management issues in the wake of his arrest last weekend, according to reports.

Perhaps Breezy heeded Mike Tyson's advice?

Brown's attorney, Mark Geragos, dropped him off at an L.A. treatment center, presumably to deal with his rage issues - and stave off a prison sentence.

His mom, Joyce Hawkins, and on-off girlfriend Karrueche Tran reportedly came to see him off as well, while his publicist confirmed that he's in treatment.

"Chris Brown has elected to enter a rehab facility," said a statement Tuesday night from his rep. There is no indication of substance abuse issues. Only rage.

"His goal is to gain focus and insight into his past and recent behavior, enabling him to continue the pursuit of his life and career from a healthier vantage point."

Following his arrest for assault in D.C. last weekend, Chris Brown's biggest problem is not the current legal situation, but his probation for assaulting Rihanna.

As you know, Brown was arrested for assault Sunday morning following a violent altercation outside a club and spent about 36 hours in jail as a result.

Monday, the charge against Chris was reduced from a felony to a misdemeanor, as the victim's injuries weren't that severe and statements conflicted.

It's almost certain that won't do any time for the incident, but the impact it could have on his probation status in the Rihanna case is far less clear cut.

The L.A. County Probation Department is conducting an investigation to determine if Chris violated his probation in the beef with the two D.C. guys.

His probation requires him to obey all laws. A violation of that rule could trigger a revocation of his freedom, something he's flirted with in the past.

The assault charge against Chris Brown, filed after his arrest early Sunday morning, has just been reduced from a felony offense to a misdemeanor.

Chris has been released from jail, where he had been for about 36 hours, with no bail. He is required to stay 100 yards away from the alleged victim.

Brown will not be required to take a drug test, as often stipulated in such cases. His bodyguard's charge was also reduced to a misdemeanor.

The controversial 24-year-old was arrested for felony assault in Washington D.C. after allegedly attacking a man outside a hotel and breaking his nose.

Brown had been in custody since, though it's unclear who threw the first punch, and the reduced charge certainly indicates some of that uncertainty.

Chris Brown has been arrested for felony assault.

Insiders tell TMZ that an incident took place around 4:30 a.m. in Washington D.C., as Brown allegedly got into a fight with a man outside the W Hotel and started punching him repeatedly.

It is not believed that the singer was under the influence of drugs or alcohol at the time.

As of this writing, the 24-year-old R&B star is in police custody, while the victim is being treated for injuries at a local hospital.
