Hello Susan:Another problem with the iofirmatnon service/telecommunication service dichotomy is the FCC's interpretation of the '96 Act that the terms are mutually exclusive. The Commission can't seem to deal with a firm that does both ina blended and convergent way. Congress intended the categories of â€˜telecommunications serviceâ€™ and â€˜information serviceâ€™ to be mutually exclusive.â€� Federal-State Joint Board On Universal Service, CC Docket No. 96-45, Report to Congress, 13 FCC Rcd. 11501, 13 FCC Rcd. 11830, n. 79 (1998). â€œBased on our analysis of the statutory definitions, we conclude that an approach in which â€œtelecommunicationsâ€� and â€œinformation serviceâ€� are mutually exclusive categories is most faithful to both the 1996 Act and the policy goals of competition, deregulation, and universal service.â€� Id. 13FCC Rcd. at 11530 (1998).
