In a Constitutionally sound Democracy, this would have never happened. So I guess you could say, Spitzer put too much faith in the System in which he lives and works.
This is why we used to be considered a Country of Law's and not Men. Law's generally allow an individual to make choices, based on a set of guidelines which dictate the consequences of those actions, should one find him or herself in a position where they must answer questions. Its reasonably assumed that a man with responsibilities such as Spitzer, would take into account every aspect of the law, before getting involved in such an encounter based on the Law and jurisprudence.
If however, the laws as prescribed by a set standard of jurisprudence has been compromised, and individuals responsible for enforcing those laws, and also abiding by them, are they themselves circumventing those laws, then anything goes.
