Ugliest celebrity divorce ever?

Kelly Rutherford of Gossip Girl has been granted a temporary restraining order against her estranged husband the father of her two kids, Daniel Giersch, after, among other things, accusing him of intimidating and threatening her nanny.

He was also being inflexible with his scheduled custody visits and stressing her out so much she's having a hard time breastfeeding, according to the actress.

In a lengthy declaration filed Thursday in Los Angeles Superior Court, Rutherford states that Giersch doesn't comply when she wants to take their 3-month-old daughter Helena to work with her in the morning so that she can nurse.

"From time to time I have some extra milk, but I never know when that will be... I believe that the stress Daniel has created for me is also negatively impacting my ability to produce milk," said the 40-year-old actress.

Way TMI, Kelly, but what can you do.

For his part, Giersch said in his own court filing Thursday that Rutherford is the one who's switching up the visits on him and he has "concerns that Kelly, her caretakers, and Kelly's mother are causing immediate harm to [their] children."

But he's the one who's got to lie low for awhile.

A judge has ordered Giersch to stay at least 100 yards away from Rutherford, Helena and their son Hermes "except for brief and peaceful contact as required."

The order also extends to nanny Michaela Kothanova, who stated that Giersch was always asking her questions about Kelly and once threatened to sue her.

A hearing on the matter is set for October 15. Rutherford was pregnant with Helena when she filed for divorce in January, citing irreconcilable differences.

The two have been in and out of court ever since, hiring PIs and haggling over the kids' potty-training, pool fences, residency, school, travel, and more.

He also learned online she had their baby. Cold.

But a source says the birth came as a surprise to businessman Giersch, who is currently in midst of a heated divorce with Rutherford, to put it mildly.

Giersch had filed paperwork to be notified when Rutherford goes into labor, says the source. But an insider tells Us Weekly that this did not happen.

The source tells the tabloid that "[Rutherford] failed to tell him and instead he found out this morning on the Internet. He was robbed of an opportunity to be at the hospital when his child is born. He is sad and disappointed."

After two years of marriage, Rutherford filed for divorce from Giersch in January - about a month after announcing she was pregnant with their second child.

The two have since engaged in a nasty war of words over who is the better parent as they continue to fight for custody of their son, Hermes, 2.

Asked at a May 22 hearing if she and Daniel Giersch could have an amicable relationship, Kelly Rutherford told reporters: "I don't see it."

This often happens when you don't call him when you give birth or have a P.I. tail your ex to make sure he keeps the pool cover on.

It's quite the day for celebrity divorce drama.

Now it's Gossip Girl star Kelly Rutherford and estranged hubby Daniel Giersch making a play for the most dysfunctional marriage title. They may have a case.

Rutherford, 40, claims their son, Hermes, is in danger because Giersch, 34, leaves the swimming pool uncovered at his Los Angeles home.

She knows this how?

Because the semi-crazy former Melrose Place star hired a private investigator last week to conduct three days of video surveillance on Giersch, natch.

So much for her pledge to "resolve things amicably."

"Hermes is very young, very active, not water safe and in a moment's notice, could fall into the swimming pool," Kelly Rutherford warns in a court filing.

Giersch's response: "Hermes is not in any danger whatsoever with regard to my pool because I have the pool fully covered with an automatic pool cover," "Hermes has no access to the pool area unless I take him to the pool myself."

Although video footage does confirm the pool was uncovered over three days, nothing egregious was witnessed, according to the investigator's reports.

Either way, a judge ordered Giersch to keep his pool covered at all times.

Meanwhile, a hearing Friday will address their differences over whether it's too stressful a time to potty train Hermes while his parents are in the midst of a divorce and custody battle and since the child is about to become a big brother.

Yes, as Gossip Girl fans surely know, Rutherford is pregnant with the ex-couple's second child, a girl, and is due to give birth in three weeks. Stay tuned.

A judge just ruled that Gossip Girl star Kelly Rutherford, who's embroiled in a nasty divorce battle, can take her kid to N.Y. City while she films the show.

The judge said Kelly can go Sunday and her estranged hubby, Daniel Giersch, is free to travel there as well. He argued he needed to stay in L.A. to do business, but the judge begged to differ. Daniel told the court he will travel to NYC.

Kelly Rutherford filed for divorce on December 30. Their son, Hermes, is two years old. She is also pregnant again with their second child.

Giersch was awarded two overnight visits per week for February and three per week in March. They all need to be back to L.A. for a minimum of four days, at least twice. During L.A. stays, Hermes will alternate between the two parents.

The judge also ruled that Hermes will bounce between NYC and L.A. for two months while the feuding couple tries to hash out a long-term arrangement.

Gossip Girl fans can breathe a sigh of relief as Kelly's character, Lily van der Woodsen, won't be killed off as a result. She had said she was prepared to stay in L.A., whatever the consequences, if she could not take Hermes with her.

Rutherford just filed legal papers that the judge will consider tomorrow in a hearing. Rutherford's husband, Daniel Giersch, wants the judge to prohibit his soon-to-be ex-wife from taking two-year-old Hermes to New York to film Gossip Girl.

Rutherford claims Giersch has gotten into big arguments with her, in one case allegedly coming at her. She says he's an avid kickboxer and she's "intimidated by him."

She also says he's threatened to "teach her a lesson" by taking Hermes. Kelly Rutherford, who is four months pregnant with the couple's second child, says it's gotten so bad she called the cops twice and he's been forced to leave.
