Both Rob Lowe and Jessica Gibson had important parts of their cases thrown out in court - and if you ask their attorneys, they both won.

The judge threw out Jessica's retaliation claim, but the judge also tossed out four Lowe claims - one being an allegation of defamation.

Jessica Gibson's attorney, Gloria Allred, said in a statement:

"He lost the heart of his case, which is defamation, and we are permitted to proceed with the heart of our case, which was and still is our allegation that Rob Lowe sexually harassed Jessica Gibson."

Lowe's attorney, Larry Stein, told celebrity news site TMZ:

"We are delighted with the court's ruling today. It removed the retaliation claim, which Ms. Allred had been focusing on and left in six claims, which allows us to prosecute every claim we've made."

Well, that settles that. Only not at all. She still says he spanked it in front of her, he says she skanked it in front of everyone, etc.

Round two of the Rob Lowe and Jessica Gibson battle is on - and juicy!

According to court documents released Friday, Gibson - the former nanny who is accusing the actor of sexual harassment - repotedly offered sex to the family's tennis instructor. Oh yes. We told you it was juicy.

In a sworn declaration, instructor Nigel Armstrong stated that Jessica Gibson "told me shortly after we first met [in mid-2005] that she was interested in me... She was very forward and did not seem concerned with being discreet."

As reported by People, Armstrong described an incident in the kitchen of the Lowe London house in which Gibson was nude from the waist down and "invited me to have sex even though [the Lowes' children] were in the general area. I was shocked by her audacity."

Heck, Lindsay Lohan would be shocked by that audacity.

According Rob Lowe, Jessica Gibson loves to solicit sex from fellow employees.

Armstrong added that Gibson was displeased he would not take their relationship further, allegedly begging him leave his girlfriend and "taking the relationship with me more seriously... She would tell me that she loved me on a number of occasions."

Another former employee, James Maclear, who was a private chef for Rob and Sheryl Lowe, described an incident in which Gibson "changed into hot pants and was laying on the kitchen floor with her legs open in a very suggestive manner."

Both men described Gibson as having unabashedly sung the Pussycat Dolls' lyric "Don't cha wish your girlfriend was hot like me."

Somewhere, Nicole Scherzinger must be ashamed their song to be used in such a manner.

Rob Lowe won a pair of small victories Thursday in the first courtroom showdown against former nanny Jessica Gibson.

Santa Barbara, Calif., Superior Court Judge Denise de Bellefeuille threw out two of the 12 allegations made by Gibson, 24.

Jessica Gibson's sexual harassment claims against Rob Lowe remain intact.

The two allegations thrown out - on the grounds that there was no legal basis - were related to labor-code violations.

"We're pleased with today's outcome," said Rob Lowe's attorney Larry Stein. "The Lowes have consistently denied any wrongdoing and will be vindicated."

Gibson's lawyer, John West, responded in kind: "We don't consider this a setback at all, Jessica's case is still intact as a whole."

Neither Rob Lowe nor Jessica Gibson was present at court.

"She's been lying low," West said of Jessica Gibson. "This has been a very traumatic situation for her, she's doing her best to heal."

Former nanny Jessica Gibson has accused Rob Lowe of dropping his pants.

Now, the actor wants a California court to drop the lawsuit filed against him by Gibson.

Lowe is asking the court to dismiss portions of a countersuit against him by the woman who says he showed her his genitals one too many times, according to documents released yesterday.

"Each of Gibson's [accusations] is completely unfounded ... but nine of those ... are subject to immediate dismissal because she has failed ... to even allege the essential elements of a claim of relief," Lowe's attorney Larry Stein wrote.

Among the charges Stein wants to see dismissed are: unpaid overtime, meals and rest periods. Penis flashing, evidently, would still be on the table.

A court date to hear the request for dismissal is set for June 19.

Simply by accusing Rob Lowe of sexual harassment, Jessica Gibson has made a boatload of money.

We're not saying this automatically means the actor's former nanny is a liar, but we do question anyone's motives when he or she begins to pop up in every celebrity gossip tabloid out there.

"Jessica has nothing to hide, and we wonder if Mr. Lowe will take that position as well," attorney Gloria Allred said of Gibson, who is seen here in a photo shoot for People Magazine.

Indeed, the woman who has referred to Lowe and his wife Sheryl's behavior as "offensive, insulting, unwelcome, mean, perverted, crude and lascivious," doesn't appear afraid to make a name - and a buck - for herself off of it.

In response, the Lowes' attorney, Stanton "Larry" Stein has countered via the following statement:

"An investigation of dozens of present and former employees has failed to find one single person to verify her allegations."

This just in: the parents of Jessica Gibson are on her side!

"I was shocked when I heard about everything [and] I worry about her capability to cope with things," Jessica Gibson's father Jim told People Magazine.

The situation being referred to, of course, is the fact that Jim's daughter has accused former employer Rob Lowe of exposing his penis to her on multiple occasions. Sorry. We're just reporting the facts.

Meanwhile, Eileen Gibson finds it "absurd to say she tried to extort from the family. She is very compassionate, very caring and honest. She has a gift for working with kids. She loves them. She's very gentle and kind and values her family very much."

Also on Jessica's side? Her older sister, Kelly Gibson:

"She was always the babysitter growing up. She's Auntie Jessie to my daughter Alicia. I always told her she would be the best mother and wife."

Now, according to Lowe, Jessica Gibson is simply the best liar.

In actuality, current and former employees of Rob Lowe weren't nearly as creative in their defense of him as The Hollywood Gossip staff was in the headline above.

Nevertheless, they have spoken to People Magazine about the sexual harassment claims made by Lowe's former nanny, Jessica Gibson.

Carol Andrade, Lowe's estate manager, defended the actor in a written declaration given to Lowe's legal team. It reads:

"Jessica never told me ... that Rob ever said or did anything that she found inappropriate or offensive or that made her feel uncomfortable ... or made sexual advances toward her."

Seen here at the premiere for Thank You for Smoking, Rob Lowe and wife Sheryl are saying "Thank you for sucking!" to former employee Jessica Gibson.

Meanwhile, Jennifer Dynof, president of tremendously-named Lowe Profile, a company owned by Lowe, similarly stated that she'd never witnessed any questionable behavior by her employer.

"[In the past four years working for Rob], I have never seen him make any sexual advances toward any other woman or act inappropriately, offensively or disrespectfully toward any woman," Dynof said.

Both employees added they would testify in court if need be.

Rob Lowe starred on The West Wing. According to former nanny Jessica Gibson, though, this actor belonged on The West Sch-wing!

Abysmal Wayne's World jokes aside, more lewd details are now emerging from the lawsuit Gibson has filed against her former employer.

Based on documents TMZ has uncovered, Lowe is accused of repeatedly exposing his "flaccid penis" and his "erect penis" to Gibson; repeatedly asking her "to touch his penis;" often masturbating in front of her; and showing her pornographic photos on her computer.

And that's merely Rob!

Gibson also alleges that Sheryl Lowe walked around naked -"completely exposing herself" - and made "numerous sexually vulgar comments about male genitalia," while talking far too openly about her sex life with her husband.

Overall, Jessica is suing the Lowes for sexual assault and battery, sexual harassment, retaliation, unpaid off-the-clock work, overtime wages and unpaid meal periods. She's asking for damages in excess of $50,000.

So... which side do you believe? Jessica Gibson or Rob Lowe?

Former Rob Lowe nanny Jessica Gibson appeared on the Today show this morning. Through her fame-whore lawyer, Gloria Allred, Gibson accused the actor of sexual battery, along with a number of other acts.

Gibson said she never blackmailed Lowe to the tune of $1.5 million (as he claims) and never called the police to report the alleged battery during her seven-year stint with the Lowes because she "loved the children, and I needed the job."

According to Jessica Gibson's lawsuit, Rob Lowe repeatedly exposed himself and inappropriately touched himself and his former nanny.

The documents go on to say Lowe "placed his hand inside Gibson's pants."

How will this case play out? It's hard to say, states Patrick Fraioli, an L.A. employment attorney, given the nature of the charges.

"This is a classic he said/she said dispute," said Fraioli.

"If Rob Lowe is without fault, he's got reason to fight to the bitter end â€" but in a trial, both sides will likely be dragged through the mud."

Rob Lowe is smiling now. But Jessica Gibson's accusations are no laughing matter.

Jessica Gibson, one of the ex-employees making sordid allegations against Rob Lowe and his wife, is in this lawsuit to win it.

According to TMZ, Gibson - a former nanny of Lowe's who claims she had an affair with the actor - has hired celebrity lawyer Gloria Allred to represent her. Lowe has claimed that Gibson tried to extort him to the tune of $1.5 million in exchange for keeping quiet about their affair.

Rob Lowe is known to movie fans for Thank You For Smoking and televisions fans for The West Wing.

While Gibson and two other former employees demand money from Lowe, he's countered with a suit that says he's the victim of an extortion plot and that the three employees have engaged in a variety of misdeeds, including sex on his bed while he and his wife were gone.

Oddly, none of the employees are Lindsay Lohan.
