James Holmes will ask a judge to allow him to change his plea to not guilty by reason of insanity in the 2012 Aurora, Colorado movie theater shooting.

Holmes faces murder and attempted murder charges in the July 20 attack, which killed 12 and injured 70. He will seek the new plea at a hearing today.

No motive has emerged, but Holmes' attorneys have repeatedly said their client is mentally ill. It was reported that he tried to commit suicide in jail.

Prosecutors are seeking the death penalty.

An insanity plea carries risks for both sides. Holmes must submit to a mental evaluation by state doctors, whose findings could be used against him.

The plea also might make it harder for prosecutors to get a conviction, as they must convince jurors that Holmes was sane at the time of the event.

James Holmes deserves to die for what he did, according to prosecutors who announced today they are seeking the death penalty for the mass murderer.

Arapahoe County (Colo.) D.A. George Brauchler explained, "It is my determination and intention that in the case of James Eagan Holmes, justice is death."

The announcement comes in the wake of a deal offered by Holmes' team, in which he would plead guilty to murdering 12 people in exchange for life in prison.

The deal didn't sit well with prosecutors, who accused his camp of leaking the offer to the media "for the intended purpose of generating predictable publicity."

Holmes’ rumored religious conversion has been widely rumored, yet scrutinized by some media sources, citing a lack of credible evidence.

The Daily Mail first ran with the story that Holmes converted to Islam in jail and is now a dedicated Muslim who prays five times a day.

The newspaper received the tip from a prison source, who noted Holmes’ beard, in his most recent court appearance, as evidence of his conversion.

“He has brainwashed himself into believing that he was on his own personal jihad and that his victims were infidels,” the source said of Holmes.

A Colorado judge entered a plea of not guilty on behalf of James Holmes, whose attorney said he was not ready to enter one in the Aurora shooting case.

The judge thus entered a not guilty plea for him and said he could change the plea to not guilty by reason of insanity, the Associated Press reports.

James Holmes, who faces 166 counts of murder, manslaughter and other crimes for the July 2012 massacre, sat silent, but alert, at the hearing.

He alternately appeared to look at the judge and stare into space.

James Holmes, the alleged shooter in the Aurora movie theater massacre, was hospitalized after running headfirst into a jail cell wall in an apparent bid to kill himself.

Law enforcement authorities described the 24-year-old's self-inflicted injuries as "half-hearted" attempts to commit suicide, CBS4 Denver reported.

Though he was released yesterday, the judge accepted a request from his attorneys to postpone a hearing today due to Holmes' stay in an area hospital.

Shirley Wygal, whose daughter lost her life inside an Aurora, Colorado movie theater on July 20 and who is now suing the owners of that theater, has hired Jose Baez has her attorney.

Baez is best known as the lead lawyer in the Casey Anthony case. After helping that accused murderer go free, he wrote a book in which he detailed Anthony's perceived mental issues.

Wygal believes the theater, due to its lax security, should be held partially responsible for the alleged actions of James Holes.

In a statement, she tells TMZ:

"When police came that night with official word, Rebecca's baby asked, 'How did he get in?' Dissatisfied with the answer, she asked again. At just 5 years old, she wants to know how it could happen and so do I. If any entity had an obligation to protect the innocent and did not, then every survivor and loved one left behind must hold them accountable. The first step is a timely and thorough investigation.

"I've engaged a firm large enough to help us all. I am confident in their expertise and appreciate their making this a priority. Rebecca would love these attorneys. As a mom, she'd want her girls to have the truth. As a daughter, she'd insist I find that truth for them."

Dave Mustaine's claim that President Obama is responsible for the Aurora, Colo., shooting tragedy last month are ridiculous, says victim Carli Richards.

Richards, one of the 70 people who was shot in the theater that night (and one of the 58 to survive it), hit back at Mustaine's conspiracy theory today.

After hearing that Mustaine said Obama staged the Aurora shooting to push an anti-gun agenda, Richards said the rocker likely just wants attention:

"Some people think the President is a good scapegoat but he didn't shoot me," she said.

"It’s obviously absurd and people who make up conspiracies just want attention."

"Everybody is emotional at this time and needs to blame somebody I guess."

"I don’t think they realize the consequences of not being responsible for your own actions and James Holmes needs to be held accountable for his, to whatever extent the criminal justice system deems fit."

Speaking of the actual person responsible, Richards, 22, previously said she'd like Holmes to die a slow, painful death, as lethal injection is too humane.

Megadeth frontman Dave Mustaine says President Barack Obama somehow "staged" the recent Colorado shooting as part of a conspiracy to ban guns. Seriously.

In comments that may put even Ted Nugent to shame, Dave suggested that Obama was behind the massacre perpetrated by James Holmes ... and a lot more.

At a Tuesday, August 7 performance in Singapore, Mustaine told the crowd, "Back in my country, my president ... he's trying to pass a gun ban."

"So he's staging all of these murders, like the 'Fast And Furious' thing down at the border ... Aurora, Colorado, all the people that were killed there ... and the beautiful people at the [Wisconsin Sikh temple]."

The rocker continued, "I don't know where I'm gonna live if America keeps going the way it's going because it looks like it's turning into Nazi America."

One major hole in Mustaine's "theory" (besides basic facts): Obama has not made any push for gun control in the wake of these tragedies.

James Holmes made another appearance in court today, as a hearing was held to listen to arguments from media outlets who believe a judge should unseal various documents related to the July 20 movie theater shooting in Aurora, Colorado.

Both sides - the prosecution and the defense - actually prefer to keep these documents away from the public while the case is pending.

But while a decision was not made regarding that issue, Holmes' attorneys did show their hand a bit:

They asked for prosecutors and investigators turn over every shred of evidence in their possession in order for the alleged killer's legal team to make a determination.

"We cannot begin to assess the nature and the depth of Mr. Holmes' mental illness until we receive full disclosure of all the documents," a lawyer told the judge, hinting they will pursue an insanity defense.

Holmes faces 24 counts of first-degree murder. The state has not revealed yet whether it plans to ask for the death penalty.

Jeffrey Ross arrived for the Comedy Central Roast of Roseanne Barr yesterday dressed as Joe Paterno and accompanied by two young boys in only Penn State helmets and a towel.

To many, though, this get-up was actually NOT the most offensive act by the comedian during the event.

Still wearing his costume, Ross took to the podium and addressed a red-haired Seth Greene with a clear reference to alleged Colorado shooter James Holmes:

“Congratulations,” Ross said to Green. “This is actually a really big night for you. You haven’t gotten this much attention since you shot all those people in Aurora.”

To a mixture of boos and scattered applause, Ross then added: “I’m kidding! You’re not like James Holmes. At least he’s doing something in a movie theater that people remember.”

Zing... ouch... and totally inappropriate?

Ross' attempt at humor came a week after Dane Cook also made a stand-up joke about the incident, although at least Ross focused his quips on Holmes. Cook actually made fun of the victims.

Still, even Roseanne herself said afterward that Ross "crossed the line," adding: “But comedy is about moving the line… And where is the line in a country that has freedom of speech? Maybe there isn’t one.”
