Gary Giordano, the suspect in travel companion Robyn Gardner's disappearance in August, is suing to collect on an insurance policy he took out on her.

Giordano, 51, filled the lawsuit last week against American Express for $3.5 million for failing to pay him the death benefit he says he is entitled to.

Gardner presumably died after her August 2 disappearance but has not been found.

Giordano says the accidental death policy was part of regular travel insurance that not only gave him coverage, but covered his traveling partner as well.

Robyn Gardner's policy is worth $1.5 million.

"When somebody takes out a policy and there is no body, they are required to wait 365 days before making a claim," American Express told ABC News.

That means Giordano won't be eligible to collect until August 2012.

Giordano tried to collect on the policy two days after he notified authorities about Gardner's disappearance, for which he was detained for months in Aruba.

"My lawyer at the time, Michael Lopez, said you need to call insurance immediately," Giordano said, claiming he was just following the standard protocol.

"I've purchased it [travel insurance] many times before. I have children. If I go traveling and I disappear, I want them to be covered, OK?"

An American Express employee who spoke to Giordano, however, later told police: "[Giordano] sounded excited, like he was about to win something."

Richard Forester, Gardner's boyfriend at the time of her disappearance, says the new lawsuit only makes him more suspicious of Gary Giordano.

On an unrelated note, he was arrested for indecent exposure last month.

Alec Baldwin may be engaged to a yoga instructor, but the Emmy-winning actor has clearly not reached a state of perpetual zen.

The 30 Rock star flipped out on a Daily News camerman in New York City this morning, as the incident was actually caught on film by another Daily News photographer and reportedly immediately by the newspaper.

Here's what went down:

After picking up the necessary paperwork to go through with their impending nuptials, Baldwin - who was accompanied by fiancee Hilaria Thomas - got into an altercation with Marcus Santos outside the city's Marriage License Bureau.

According to the reporter, Baldwin ordered him to "step back," a request Santos claims he abided by. But the actor supposedly did not listen.

"He comes after me, starts shoving and punching me - one time, right in the chin. And then he started shoving me, and pushing me. Then he goes the other way," Santos says.

Drake is solely to blame for inflaming the violent NYC club melee that injured innocent people, according to model Vladimira Brace, one of those allegedly hurt.

Brace claims she suffered a spinal injury when she was trampled in the mob scene that ensued inside the now-shut down W.i.P. nightclub in Manhattan.

Brace's attorney has threatened him with a lawsuit, writing Drake's reps that point blank, "Your client instigated a brawl with Mr. Chris Brown" on June 13.

"[Drake's] actions were negligent in inflaming a violent mob," the letter adds.

"My client personally observed several members of [Drake's] entourage throwing bottles of champagne with reckless and criminal disregard."

The attorney also cites Drake's "well documented history of vulgar, abusive and profane remarks concerning women," which his camp denies.

People close to the Canadian rapper claim that he didn't instigate anything, and was there with a couple of security guys and that's it. No entourage.

They say both Chris Brown and Meek Mill were with large posses, but not Drake. As for D's alleged abuse of women, they find that claim absurd for two reasons:

  1. It's not true.
  2. Chris Brown.

At least three other women - and NBA star Tony Parker and Chris' bodyguard Big Pat - have also claimed they were injured in the Chris Brown-Drake fight.

Roger Clemens may never make it into the Hall of Fame, but the legendary pitcher doesn't need to worry any longer about making it through a prison sentence, either.

He has been acquitted on all counts of lying to a grand jury.

Clemens was on trial for six counts of perjury, stemming from a 2008 statement in front of Congress that he never took steroids or Human Growth Hormone.

How ecstatic will the denizens of Seaside Heights, N.J., be when MTV closes the book on Jersey Shore? It's been a three-year-old melee in that town.

The latest: Ronnie Ortiz-Magro is on the receiving end of a private citizen's complaint, brought by a man who claims Ron roughed him up in a bar.

Not sure about you, but our jaws are on the floor.

Justin Viterito accused the 26-year-old Ortiz-Magro of simple assault that resulted from a brawl at the Seaside nightclub Bamboo Bar on June 9.

According to Viterito, a friend of his "was shoved by a cast member from the show" and as he moved to help, Viterito was "struck" by the star.

The complaint also named as defendants MTV and parent company Viacom in court papers. He alleges Ron-Ron belted him above the left eye.

Neither man's attorney was available for comment, nor was the cable network. But Ortiz-Magro must appear at a court hearing set for July 3.

The melee affected Ronnie's co-star Jenni "JWoww" Farley, who reportedly ended up sustaining a foot injury and was on crutches last week.

Also this month, Deena Cortese was arrested on a disorderly conduct charge and someone leaked these pre-pregnancy pics of Snooki nude.

British police are investigating David Nalbandian for injuring a linesman while kicking an advertising board during Sunday's tennis final at Queen's Club.

Officials ruled that the Argentine had to default the match to Marin Cilic after smashing the sign - and the lineman's legs behind it - with his right foot.

Judge Andrew McDougal could be seen cringing in pain as the player sent part of the sign flying into his leg. Watch the video of his Nalbandian's outburst here:

McDougal was bloodied in the encounter but suffered no other injury. Nalbandian was leading 7-6, 3-4 at the time but was forced to default the match.

By doing so, he forfeited significant prize money and rankings points in the process ... all while injuring a linesman for no reason. Definitely worth it.

What's more, criminal charges may be in the offing.

"We are aware of an incident at the Aegon Championships on June 17," a Scotland Yard spokesman said. "A complaint has been made and the Metropolitan police service is investigating the incident. The allegation is of assault."

Kris Humphries' ex-girlfriend Myla Sinanaj threatened to release sordid details about their relationship, according to a voicemail posted on TMZ.

Sources say after Myla and Kris' relationship was exposed, he broke off all contact with her and she was PISSED, calling him 17 times. No response.

Irate, she began dialing up his friends too and threatening to "expose" Kris.

That's when Myla apparently left a message, demanding that Kris stop stonewalling her and return her calls, allegedly threatening to one friend:

"If he's going to play me like that, I have way more sh!t I can put out."

The voicemail does not show Myla Sinanaj plotting or committing extortion against Kris, as he has claimed ... but he has turned it over to the FBI.

Alleged extortion aside, Kris apparently wants to muzzle Myla because his tryst with her will hurt his divorce case against Kim Kardashian somehow.

Myla's attorney has demanded he apologize and retract the extortion statement ASAP or he will be receiving a nice defamation lawsuit.

Tacopina says Myla was indeed angry when she read that Kris was calling her a "booty call" and that she has proof of a "substantial relationship."

One that involves Myla meeting Kris' parents, helping his sister Kaela shop for furniture, spending many evenings together at home cooking, and so on.

After the voicemail leaked online, Myla Sinanaj apparently posted a flurry of bitter tweets to the NBA star hammering him for that too.

This situation? Real normal.

A model who claims she required 12 stitches after she was caught up in last week's Chris Brown-Drake fight plans to sue ... possibly both of the musicians.

Javier Solano, a lawyer representing Lucy Pavlovsky, says the model was in the VIP section at W.i.P. Nightclub when the violent fight went down.

He says Lucy ducked down when bottles started flying and didn't notice her arm was gushing blood until she was making her way out of the club.

Solano says Lucy took a cab to the nearest hospital, and got a total of 12 stitches to close up two cuts on her arm, along with a tetanus shot.

According to Solano, Lucy Pavlovsky was interviewed by NYPD officers on Friday. She is "gathering evidence" for a possible criminal complaint.

Solano says Lucy's lawsuit would be against the club, which was shut down for various violations, but hinted Drake and/or Brown could be included.

"At this moment we are exploring all options," he said. "I can assure you that regardless of fame, money or stature, the people responsible will be held accountable."

Also injured in the fight, allegedly over Rihanna:

  • Chris Brown himself; his chin was gashed.
  • Chris' bodyguard Big Pat, whose head was bashed.
  • San Antonio Spurs guard Tony Parker, whose eye was cut.
  • Ingrid Gutierrez, a 21-year-old model who was at Brown's table and suffered "bruises, stitches and trauma to her face," according to reports.

NFL star Pacman Jones, the poster child for pro athletes behaving badly, must pay $11.6 MILLION in damages to the victims of a Las Vegas strip club shooting.

Pacman (real name Adam) had been sued by Aaron Cudworth and Thomas Urbanski, two security guards who were shot outside Minxx strip club in February 2007.

The now-famous incident began when Jones "made it rain" with THOUSANDS of $1 bills ... then got pissed when a stripper began taking it without his permission.

A fight ensued outside the club and three people were shot, including Cudworth and Urbanski. Pacman was sued, even though he was not the actual shooter.

A Nevada jury found Pacman Jones responsible and awarded Cudworth $1.3 million in damages. Urbanski, who was paralyzed from the waist down, got $9.6 million.

Urbanski's wife sued for loss of marital relations and won $750,000.

At the time Pacman pleaded no contest to conspiracy to commit disorderly conduct, receiving just a year's probation and 200 hours of community service.

He was suspended for the entire 2007 NFL season and part of 2008 as a result, and is currently a member of the Cincinnati Bengals ... at least for now.

Jacob Anthonisen, an art dealer and friend of Lindsay Lohan and other stars, is currently being sought in a murder investigation, according to Radar Online.

The 37-year-old, who runs with the likes of Emile Hirsch, Mickey Avalon, Taryn Manning and Lady Victoria Hervey, has been named a person of interest.

On June 9, a decomposing body was found in the back of a Cadillac Escalade registered to Jacob Anthonisen in a parking lot in West Hollywood, Calif.

The remains were identified on Thursday as Steven John Simmons - Jacob's stepbrother - and the cause of death was a gunshot wound to the chest.

"He has been involved with some very dangerous people in the past, and we are worried that they have something to do with this," a close pal said.

Anthonisen, who owns The Peanut Gallery in L.A., has been missing since May 31. "At this point, everyone is just hoping he is alive and well," a pal said.

"But it's no secret that he served time in prison for drugs, so it's something to consider here. The circumstances lead us to believe drugs played a role."

Anthonisen has something of a troubled past, having served two years in prison from 2003-2005. He was convinced on drug-related charges in Arizona.
