It may be some time before the L.A. District Attorney's office charges either Mel Gibson or Oksana Grigorieva with domestic abuse or extortion, respectively.
That's if charges are filed at all. In the meantime, her lawyers want to grill Mel's ex-wife about claims that the actor was never violent during their marriage.
Team Oksana is poised to subpoena Robyn Moore Gibson to appear before a deposition. Mel left Robyn around the same time he got together with Oksana.
Shortly after news of Mel's divorce hit, Oksana Grigorieva became pregnant. She and Mel are also battling for custody of daughter Lucia, now nine months.
Oksana has told police that Mel once admitted hurling a TV at Robyn Gibson, and claims that she personally witnessed him hit his youngest son, Tommy.
Oksana Grigorieva would like a word with Robyn Gibson - under oath.
Robyn Gibson came to Mel's defense earlier this summer with a sworn affidavit submitted to the court stating Mel was never once abusive to her or his kids.
"Mel never engaged in physical abuse of any kind toward me before, during, or after our marriage," Robyn reportedly told the judge overseeing the case.
Robyn's support was surprising in the wake of how their marriage ended, and the leak of Mel's phone meltdowns, leading some to question her motivation.
She and Mel have seven children, six of whom are adults. Oksana's attorneys want her to testify under penalty of perjury that he never abused anyone.
The TV incident is likely to be brought up if Robyn testifies. No word if Grigorieva's lawyers will also track down Violet Kowal, Mel's other alleged mistress.
