Britney Spears' driving-without-a-license charges have been dismissed as prosecutors decided not to retry her after the first jury deadlocked.

After five votes and eight hours of deliberation, the jury of eight men and four women failed to agree on whether the singer was guilty of driving without a valid driver's license, a misdemeanor. The vote was 10-2 in her favor.

"It's an 80 percent victory," said Spears' attorney, Michael Flanagan, who argued that the misdemeanor trial "should have never even happened" and that Britney Spears was only prosecuted "because she is a celebrity."

Her defense called father Jamie Spears to testify that the singer considers Louisiana home. She had a Louisiana license at the time of the accident.

Flanagan argued that Spears is not guilty because the state's vehicle code provides an exemption for people living temporarily in the state. He said she is only in California so she can have visitation with Sean Preston and Jayden James.
