Federal Judge: Britney Spears Case Not My Problem

Lawyers for Britney Spears' conservatorship filed papers in federal court, asking the court to reject the bid to remove the case from the California Court system.

According to TMZ, lawyers claim Britney is in no position to hire a lawyer for the federal case because she's not allowed to, per the conservatorship.

Attorney Jon Eardley, who filed the papers in federal court in an attempt to get the conservatorship nixed, claims Britney hired him. It reeks of Sam Lutfi.

Lawyers for the conservators want Eardley to identify everyone with whom he worked to get the federal case filed. Like, say, Sam Lutfi, for instance!?

The Britney Spears legal drama gets weirder by the day.

Britney Spears' father, Jamie Spears, has control of her estate. As conservator, he can regulate her medical and financial decisions, even control who she sees.

The conservators also want Eardley to pay their legal fees, claiming the federal filing is frivolous, baseless and a waste of everyone's time.

In response, a federal judge issued a tentative ruling that the move to make a federal case out of Britney Spears' situation is ridiculous.

Judge Philip Gutierrez has set a deadline of February 29 for her so-called lawyer, Eardley, to explain why on Earth the federal court has any business at all getting involved in Britney Spears' mental affairs.

The court said it seems as if the Feds have no jurisdiction, and unless Jon Eardley can convince the judge otherwise, the case will go back to State court on February 29. We will keep you posted on the latest.

    If Brittney's civil rights were violated by the guardianship proceedings, she has every right to go to federal court.

    A person's life should not be invaded, nor their freedom of choice taken from them
    by the State simply because we believe that decisions could be "better" made by others. She must be permitted to make her own decisions, whether good or bad, wise or foolish, as a condition of the liberty and integrity accorded all other citizens who have not been declared legally incompetent. The conserved person has less rights than a death row inmate. Most of the time conservatorship or guardianship is all about the money. Lawyers get paid for every move they make, phone calls, driving, court appearances, writing letters and briefs, and what ever else they can cook up. It's all about the money!! Greed is not good.

    A contested conservatorship is a feast for the lawyers - all of whom are getting paid from the ward's estate. In Britney's case, because she is working and bringing in even more wealth, she is actually supporting the conservatorship, albeit unwillingly.

    It's in the lawyers' best interest to keep Britney conserved.

    Conservatorship wards are stripped of all rights: the right to decide where to live and whom to associate with, how to spend (or save!) ones own money, to accept or refuse medical treatment -- or even ask for a second opinion, marry, vote, etc. Most important, wards are stripped of the right to complain.

    With the fox guarding the henhouse and the hens muzzled, conservators and their attorneys can easily unjustly enrich themselves at the expense and to the detriment of the very person they have been court-appointed to protect.

    Many wards are forcibly taken from their homes and isolated in nursing homes against their will – and family is not permitted to visit or have any information or input regarding medical “care”. Wards die prematurely – alone and afraid. The devastation victims and families suffer at the hands of the system haunts them for the rest of their lives.
