Oscar, meanwhile, is trying to send the case to a secret arbitration.

Milana Dravnel filed a memorandum to nix De La Hoya's request to get the case dismissed on grounds that she agreed to arbitrate her claims against him.

Dravnel says she never made any deal with the boxer to go to arbitration, much less an agreement to publicly disavow the Oscar de la Hoya drag photos.

Oscar's lawyer didn't immediately respond to a call for comment. Oscar and his wife, Millie Corretjer, recently welcomed their second child.
